상법 제709조(적하매각으로 인한 손해의 보상)

①항해도중에 불가항력으로 보험의 목적인 적하를 매각한 때에는 보험자는 그 대금에서 운임 기타 필요한 비용을 공제한 금액과 보험가액과의 차액을 보상하여야 한다.

②제1항의 경우에 매수인이 대금을 지급하지 아니한 때에는 보험자는 그 금액을 지급하여야 한다. 보험자가 그 금액을 지급한 때에는 피보험자의 매수인에 대한 권리를 취득한다. <개정 1991.12.31>
