성폭력범죄의 처벌 등에 관한 특례법 제9조(강간 등 살인ㆍ치사)

① 제3조부터 제7조까지, 제15조(제3조부터 제7조까지의 미수범으로 한정한다)의 죄 또는 「형법」 제297조(강간), 제297조의2(유사강간) 및 제298조(강제추행)부터 제300조(미수범)까지의 죄를 범한 사람이 다른 사람을 살해한 때에는 사형 또는 무기징역에 처한다.

② 제4조, 제5조 또는 제15조(제4조 또는 제5조의 미수범으로 한정한다)의 죄를 범한 사람이 다른 사람을 사망에 이르게 한 때에는 무기징역 또는 10년 이상의 징역에 처한다.
