소비자기본법 제64조(위원의 제척ㆍ기피ㆍ회피)
Framework Act on Consumers, Article 64 (Exclusion, Challenge, and Recusal of Members)
①조정위원회의 위원은 다음 각 호의 어느 하나에 해당하는 경우에는 제58조제1항 또는 제65조제1항의 규정에 따라 조정위원회에 신청된 그 분쟁조정사건(이하 이 조에서 "사건"이라 한다)의 심의ㆍ의결에서 제척된다. <개정 2026.3.10>
(1) A member of the Mediation Commission shall be excluded from deliberating on and deciding a dispute mediation case applied for to the Mediation Commission under Article 58 (1) or 65 (1) (hereinafter referred to as a "case" in this Article) in any of the following cases:
1. 위원 또는 그 배우자나 배우자이었던 자가 그 사건의 당사자가 되거나 그 사건에 관하여 공동의 권리자 또는 의무자의 관계에 있는 경우
1. Where the member, or the member's spouse or former spouse, is a party to the case, or is a joint holder of rights or obligations with respect to the case;
2. 위원이 그 사건의 당사자와 친족관계에 있거나 있었던 경우
2. Where the member is or was a relative of a party to the case;
3. 위원이 그 사건에 관하여 증언이나 감정을 한 경우
3. Where the member has given testimony or an expert opinion concerning the case;
4. 위원이 그 사건에 관하여 당사자의 대리인으로서 관여하거나 관여하였던 경우
4. Where the member is or was involved in the case as an agent of a party.
②당사자는 위원에게 심의ㆍ의결의 공정을 기대하기 어려운 사정이 있는 경우에는 원장에게 기피신청을 할 수 있다. 이 경우 원장은 기피신청에 대하여 조정위원회의 의결을 거치지 아니하고 결정한다.
(2) Where there are circumstances that make it difficult to expect a member to deliberate and decide fairly, a party may file a challenge against the member with the President. In this case, the President shall decide on the challenge without a resolution of the Mediation Commission.
③위원이 제1항 또는 제2항의 사유에 해당하는 경우에는 스스로 그 사건의 심의ㆍ의결에서 회피할 수 있다.
(3) Where a member falls under a ground in paragraph (1) or (2), the member may voluntarily withdraw from deliberating on and deciding the case.
