수도권정비계획법 시행령 제23조(공장 총허용량의 집행)

① 국토교통부장관은 시ㆍ도의 연도별 공장건축량이 연도별 배정계획을 지나치게 많이 초과할 우려가 있는 경우에는 수도권정비위원회의 심의를 거쳐 업종, 규모 및 기간 등을 정하여 해당 시ㆍ도의 공장건축을 제한할 수 있으며, 해당 시ㆍ도의 공장건축을 제한한 경우에는 그 제한 내용을 관보에 고시하여야 한다. <개정 2013.3.23>

② 시ㆍ도지사는 제22조제5항에 따라 지역별ㆍ연도별 총허용량을 배정한 경우 해당 지역의 연도별 공장건축량이 지역별ㆍ연도별 총허용량을 지나치게 많이 초과할 우려가 있는 경우에는 업종, 규모 및 기간 등을 정하여 해당 지역의 공장건축을 제한할 수 있으며, 해당 지역의 공장건축을 제한한 경우에는 그 제한 내용을 시ㆍ도에서 발행하는 공보에 고시하여야 한다.

③ 시장ㆍ군수 또는 구청장은 「산업집적활성화 및 공장설립에 관한 법률」 제13조제1항에 따라 공장의 신설 또는 증설에 대한 승인 신청을 받은 경우에는 해당 지역별ㆍ연도별 총허용량 및 제2항에 따른 해당 지역의 공장건축 제한 여부를 신청인에게 즉시 알려야 한다. <신설 2023.12.19>

④ 시장ㆍ군수 또는 구청장은 공장 총량관리대장을 작성ㆍ관리하고, 공장건축량을 월별로 다음 달 10일까지 시ㆍ도지사를 거쳐 국토교통부장관에게 제출해야 한다. <개정 2013.3.23, 2023.11.16, 2023.12.19>
