수소경제 육성 및 수소 안전관리에 관한 법률 시행령 제48조(안전관리자의 직무범위)
Enforcement Decree of the Hydrogen Economy Promotion and Hydrogen Safety Management Act, Article 48 (Scope of Duties of Safety Managers)
① 안전관리자는 다음 각 호의 안전관리업무를 수행한다.
(1) Safety managers perform the following safety control duties:
1. 수소용품 제조시설의 안전유지 및 검사기록의 작성ㆍ보존
1. Maintaining safety of hydrogen product manufacturing facilities and preparing and keeping inspection records;
2. 수소용품의 제조공정 관리
2. Managing the manufacturing process of hydrogen products;
3. 법 제41조에 따른 안전관리규정 이행 기록의 작성ㆍ보존
3. Preparing and keeping records of implementation of the safety control regulations under Article 41 of the Act;
4. 사업소의 종업원에 대한 안전관리를 위하여 필요한 사항의 지휘ㆍ감독
4. Directing and supervising matters necessary for safety control of employees of the business office;
5. 사업소를 개수(改修) 또는 보수하는 사람에 대한 안전관리를 위하여 필요한 사항의 지휘ㆍ감독
5. Directing and supervising matters necessary for safety control of persons who renovate or repair the business office;
6. 그 밖의 수소용품 등의 위해(危害) 방지 조치
6. Other measures to prevent harm from hydrogen products, etc.
② 안전관리책임자 및 안전관리원은 이 영에 특별한 규정이 있는 경우 외에는 제1항 각 호의 직무가 아닌 일을 맡아서는 안 된다.
(2) Safety control officers and safety control staff must not take charge of work other than the duties under the subparagraphs of paragraph (1), except where there is a special provision in this Decree.
③ 안전관리자는 다음 각 호의 구분에 따른 직무를 수행한다.
(3) Safety managers perform the following duties, as classified below:
1. 안전관리총괄자: 사업소의 안전에 관한 업무의 총괄관리
1. General safety control supervisor: overall management of work on the safety of the business office;
2. 안전관리부총괄자: 안전관리총괄자를 보좌하여 그 수소용품 제조시설 안전의 직접 관리
2. Deputy general safety control supervisor: assisting the general safety control supervisor and directly managing the safety of the hydrogen product manufacturing facilities;
3. 안전관리책임자: 다음 각 목의 직무
3. Safety control officer: the following duties:
가. 안전관리부총괄자를 보좌하여 사업장의 안전에 관한 기술적인 사항의 관리
(a) Assisting the deputy general safety control supervisor and managing technical matters on the safety of the workplace;
나. 안전관리원에 대한 지휘ㆍ감독
(b) Directing and supervising safety control staff;
4. 안전관리원: 안전관리책임자의 지시에 따른 안전관리자의 직무
4. Safety control staff: duties of safety managers as directed by the safety control officer.
④ 법 제42조제1항에 따라 안전관리자를 선임한 자는 같은 조 제3항 각 호의 어느 하나에 해당하는 경우에는 다음 각 호의 구분에 따른 기간 동안 대리자를 지정하여 그 직무를 대행하게 해야 한다.
(4) A person who has appointed a safety manager under Article 42 (1) of the Act must designate a substitute to perform the duties for the following periods, respectively, where any subparagraph of paragraph (3) of that Article applies:
1. 법 제42조제3항제1호에 해당하는 경우: 직무를 수행할 수 없는 30일 이내의 기간
1. Where Article 42 (3) 1 of the Act applies: a period of up to 30 days during which the safety manager cannot perform duties;
2. 법 제42조제3항제2호에 해당하는 경우: 다른 안전관리자가 선임될 때까지의 기간
2. Where Article 42 (3) 2 of the Act applies: the period until another safety manager is appointed.
⑤ 법 제42조제3항에 따라 안전관리자의 직무를 대행하게 하는 경우 그 대리자는 다음 각 호의 직무 구분에 따른 사람으로 한다.
(5) Where the duties of a safety manager are performed by a substitute under Article 42 (3) of the Act, the substitute is the following person, as classified below:
1. 안전관리총괄자 및 안전관리부총괄자의 직무: 각각 그를 직접 보좌하는 직무를 하는 사람
1. Duties of the general safety control supervisor and deputy general safety control supervisor: a person who performs the duty of directly assisting each of them;
2. 안전관리책임자의 직무: 안전관리원
2. Duties of the safety control officer: safety control staff;
3. 안전관리원의 직무: 해당 사업소의 종업원으로서 수소 관련 업무에 종사하고 있는 사람 중 수소안전관리에 관한 지식이 있는 사람
3. Duties of safety control staff: among employees of the business office concerned engaged in hydrogen-related work, a person with knowledge of hydrogen safety control.
