식품산업진흥법 시행령 제39조(권한의 위임ㆍ위탁)
Enforcement Decree of the Food Industry Promotion Act, Article 39 (Delegation and Entrustment of Authority)
① 농림축산식품부장관은 법 제34조에 따라 다음 각 호의 권한을 농촌진흥청장에게 위임한다. <개정 2017.12.12, 2019.6.25, 2021.2.19, 2022.11.29>
(1) Under Article 34 of the Act, the Minister of Agriculture, Food and Rural Affairs delegates the following authority to the Administrator of the Rural Development Administration:
1. 법 제13조의3에 따른 식품가공 용도에 적합한 품종 개발ㆍ보급, 재배 기술 교육 등의 사업
1. Projects such as development and dissemination of varieties suitable for food processing and cultivation technology education under Article 13-3 of the Act;
2. 법 제14조의2에 따른 대한민국식품명인 식품의 사후관리
2. Follow-up management of food of Food Masters of the Republic of Korea under Article 14-2 of the Act;
3. 법 제19조제1항에 따른 식품의 영양성분 분석 및 식품영양학적 품질 특성 등에 대한 조사ㆍ연구
3. Surveys and research on analysis of nutritional components of food and food nutritional quality characteristics, etc. under Article 19 (1) of the Act;
3의2. 법 제38조제2항에 따른 과태료의 부과 및 징수
3-2. Imposition and collection of administrative fines under Article 38 (2) of the Act;
4. 제16조제3항에 따른 대한민국식품명인의 지정 추천에 대한 적합성 검토
4. Review of the suitability of recommendations for designation of Food Masters of the Republic of Korea under Article 16 (3);
5. 제25조제1항에 따른 식품성분표ㆍ식품영양정보총람 등의 작성ㆍ공표
5. Preparation and publication of food composition tables and compendiums of food nutrition information, etc. under Article 25 (1);
6. 제25조제2항에 따른 식품성분표 등의 제공 또는 교육 및 홍보
6. Provision of food composition tables, etc. or education and public relations under Article 25 (2).
② 농림축산식품부장관은 법 제34조에 따라 법 제19조의3에 따른 농산물가공품 생산자 등에 대한 자금지원 중에서 임산물을 단순가공하거나 임산물을 원료 또는 재료로 하여 가공한 민예품에 관한 사항은 산림청장에게 위임한다. <개정 2012.7.19, 2013.3.23>
(2) Under Article 34 of the Act, the Minister of Agriculture, Food and Rural Affairs delegates to the Commissioner of the Korea Forest Service matters concerning simple processing of forest products or processed folk crafts using forest products as raw materials or materials, among fund support for producers, etc. of processed agricultural products under Article 19-3 of the Act.

(4) Under Article 34 of the Act, the Minister of Agriculture, Food and Rural Affairs delegates the following authority to the Commissioner of the National Agricultural Products Quality Management Service:
1. 법 제24조에 따른 우수식품등인증기관의 지정ㆍ재지정
1. Designation and re-designation of excellent food certification bodies, etc. under Article 24 of the Act;
2. 법 제24조의2에 따른 우수식품등인증기관의 지정취소 및 업무정지
2. Revocation of designation and suspension of business of excellent food certification bodies, etc. under Article 24-2 of the Act;
3. 법 제26조에 따른 우수식품등인증을 받은 식품 또는 음식점등과 우수식품등인증기관에 대한 사후관리
3. Follow-up management of food or restaurants, etc. that have obtained excellent food, etc. certification and excellent food certification bodies, etc. under Article 26 of the Act;
4. 법 제28조에 따른 우수식품등인증품의 표시변경명령 등의 처분
4. Dispositions such as orders to change labeling of products with excellent food, etc. certification under Article 28 of the Act;
5. 법 제29조에 따른 우수식품등인증의 취소

7. 법 제33조에 따른 우수식재료 사용을 촉진하도록 하는 시책의 수립ㆍ추진
7. Formulation and promotion of measures to promote the use of excellent food ingredients under Article 33 of the Act;
8. 법 제33조의2제1항제4호 및 제5호에 따른 청문
8. Hearings under Article 33-2 (1) 4 and 5 of the Act;
9. 법 제38조제1항제2호부터 제4호까지의 규정에 따른 과태료의 부과 및 징수
9. Imposition and collection of administrative fines under Article 38 (1) 2 through 4 of the Act;
10. 제28조에 따른 품질인증대상품목의 표준규격 제정ㆍ개정ㆍ폐지 및 그에 관한 고시
10. Establishment, amendment, and abolition of standard specifications for quality certification items under Article 28, and public notification thereof.

(7) Under Article 34 of the Act, the Minister of Agriculture, Food and Rural Affairs entrusts to the head of an excellent food certification body, etc. the affairs of receiving reports of succession to the status of a person who has obtained excellent food, etc. certification under Article 30 (2) of the Act.

(10) Under Article 34 of the Act, the Minister of Agriculture, Food and Rural Affairs entrusts the following affairs to the Korea Agro-Fisheries and Food Trade Corporation under the Korea Agro-Fisheries and Food Trade Corporation Act:
1. 법 제7조에 따른 식품산업 전문인력 양성 업무
1. Affairs of training food industry specialized personnel under Article 7 of the Act;
2. 법 제9조에 따른 식품산업 통계의 조사 및 분석을 위한 업무
2. Affairs for surveying and analyzing food industry statistics under Article 9 of the Act;
3. 법 제15조에 따른 식품산업 컨설팅 지원을 위한 업무

⑪ 농림축산식품부장관은 법 제34조에 따라 법 제17조에 따른 전통식품과 식생활 문화의 세계화에 관한 업무를 「한식진흥법」 제16조에 따라 설립된 한식진흥원에 위탁한다. <신설 2012.7.19, 2013.3.23, 2017.12.12, 2020.8.27>
(11) Under Article 34 of the Act, the Minister of Agriculture, Food and Rural Affairs entrusts affairs concerning globalization of traditional food and dietary culture under Article 17 of the Act to the Hansik Promotion Institute established under Article 16 of the Hansik Promotion Act.
