신원보증법 제6조(신원보증인의 책임)

① 신원보증인은 피용자의 고의 또는 중과실로 인한 행위로 발생한 손해를 배상할 책임이 있다.

③ 법원은 신원보증인의 손해배상액을 산정하는 경우 피용자의 감독에 관한 사용자의 과실 유무, 신원보증을 하게 된 사유 및 이를 할 때 주의를 한 정도, 피용자의 업무 또는 신원의 변화, 그 밖의 사정을 고려하여야 한다.
