실용신안법 제16조(등록료)

① 제21조제1항에 따른 실용신안권의 설정등록을 받으려는 자는 설정등록을 받으려는 날(이하 "설정등록일"이라 한다)부터 3년분의 등록료를 내야 하고, 실용신안권자는 그 다음 해부터의 등록료를 해당 권리의 설정등록일에 해당하는 날을 기준으로 매년 1년분씩 내야 한다.

② 제1항에도 불구하고 실용신안권자는 그 다음 해부터의 등록료는 그 납부연도 순서에 따라 수년분 또는 모든 연도분을 함께 낼 수 있다.

③ 제1항 및 제2항에 따른 등록료, 그 납부방법 및 납부기간, 그 밖에 필요한 사항은 총리령으로 정한다. <개정 2025.10.1>
