양식산업발전법 제38조(양식업권의 행사)

① 어촌계와 내수면어업계가 가지고 있는 양식업권은 제40조제1항에 따른 양식장관리규약으로 정하는 바에 따라 그 어촌계나 내수면어업계의 계원 또는 준계원이 행사한다.

② 지구별수협 및 업종별수협이 가지고 있는 양식업권은 대통령령으로 정하는 경우 외에는 제40조제1항에 따른 양식장관리규약으로 정하는 바에 따라 그 양식장에 인접한 어촌계의 구역에 주소를 두고 있는 해당 지구별수협 및 업종별수협의 조합원이 행사한다. <개정 2023.8.16>

③ 제1항 또는 제2항에도 불구하고 면허권자는 어촌계원ㆍ준계원, 지구별수협 또는 업종별수협 조합원의 균등한 소득 증대를 위하여 대통령령으로 정하는 기준에 해당하는 자에 대해서는 어촌계나 내수면어업계, 지구별수협 또는 업종별수협의 양식업권 행사를 제한하거나 금지할 수 있다. <개정 2023.8.16>

④ 제1항 및 제2항에 따른 양식업권의 행사방법과 행사의 우선순위, 어촌계원ㆍ준계원별 또는 조합원별 양식시설의 설치ㆍ사용량 또는 양식업권 행사의 구역 조정, 그 밖에 양식장의 관리에 필요한 사항은 해양수산부령으로 정한다.
