Aquaculture Industry Development Act, Article 67 (Compensation)

① 다음 각 호의 어느 하나에 해당하는 처분으로 손실을 입은 자는 그 처분을 한 행정관청에 보상을 청구할 수 있다.

1. 제26조제1항제1호부터 제6호까지(제52조에 따라 준용되는 경우를 포함한다)에 해당하는 사유로 제26조제1항(제52조에 따라 준용되는 경우를 포함한다), 제27조제1항 및 제51조에 따라 면허ㆍ허가의 제한, 정지 및 취소 등의 처분을 받았거나 제17조제2항에 따른 면허의 유효기간 연장이 불허된 경우. 다만, 제26조제1항제1호부터 제3호까지의 규정(제52조에 따라 준용되는 경우를 말한다)에 해당하는 사유로 허가의 제한, 정지 및 취소 등의 처분을 받은 경우는 제외한다.

② 행정관청은 제1항에 따른 보상의 원인이 된 처분으로 이익을 받은 자(이하 "수익자"라 한다)가 있으면 그 수익자에게 그가 받은 이익의 범위에서 제1항에 따른 보상액의 전부 또는 일부를 부담하게 할 수 있다. 이 경우 수익자가 부담하도록 결정된 금액을 내지 아니하면 「지방행정제재ㆍ부과금의 징수 등에 관한 법률」에 따라 징수한다. <개정 2020.3.24>

③ 수익자는 제1항에 따라 보상을 청구할 수 있는 자에게 미리 보상을 하지 아니하면 손실에 영향을 미치는 행위나 공사에 착수할 수 없다. 다만, 보상을 청구할 수 있는 자의 동의를 받은 경우에는 그러하지 아니하다.

④ 제1항에 따른 보상의 기준, 지급방법, 그 밖에 보상에 필요한 사항은 대통령령으로 정한다.
