어선원 및 어선 재해보상보험법 시행령 제29조(보험료 등의 과납액의 충당 및 반환)

① 법 제42조제1항 각 호에 규정된 금액의 충당 순위는 다음 각 호의 순서에 따르되, 같은 호에 해당하는 금액이 둘 이상인 경우에는 납부기한이 빠른 것을 선순위로 한다.

② 보험가입자는 법 제36조제1항에 따른 어선원보험료(이하 "어선원보험료"라 한다. 이하 같다) 등 이 장에 따른 징수금을 낼 때에 과납액이 발생하거나 법 제35조에 따라 보험급여를 받을 권리를 대위하게 되는 경우에는 이를 다음 연도의 어선원보험료 등 이 장에 따른 징수금에 충당시켜 줄 것을 중앙회에 신청할 수 있다.

③ 중앙회는 법 제42조제1항 각 호의 금액을 어선원보험료 등 이 장에 따른 징수금에 우선 충당하거나 그 잔액을 반환하려는 경우에는 보험가입자에게 이를 알려야 한다.

④ 법 제42조제2항에서 "대통령령으로 정하는 이자율"이란 반환하여야 하는 사유가 발생한 시점에 수협은행이 「수산업협동조합법」 제141조의9제1항제5호에 따른 은행업무로 행하는 1년 만기 정기예금 이자율을 말한다. <개정 2016.11.8>
