연구개발특구의 육성에 관한 특별법 시행령 제41조의2(손해배상금의 지급)

① 법 제69조의2제1항 본문에 따라 손해배상금을 손해배상을 받는 자 명의의 지정된 계좌(이하 이 조에서 "수급전용계좌"라 한다)로 받으려는 자는 손해를 배상할 책임이 있는 자가 정하는 배상금 지급청구서에 본인 명의의 수급전용계좌를 기재하고, 계좌번호가 표시된 통장 사본(이에 상응하는 전산자료의 출력물을 포함한다)을 첨부하여 손해를 배상할 책임이 있는 자에게 제출해야 한다.

② 법 제69조의2제1항 단서에서 "대통령령으로 정하는 불가피한 사유"란 수급전용계좌가 개설된 금융기관이 폐업ㆍ업무정지 등으로 정상영업이 불가능한 경우를 말한다.

③ 손해를 배상할 책임이 있는 자는 법 제69조의2제1항 단서에 따라 정보통신장애나 제2항에 따른 사유로 손해배상금을 해당 수급전용계좌로 이체할 수 없을 때에는 손해배상을 받는 자의 신청에 따라 손해배상을 받는 자가 다른 금융기관에 개설한 수급전용계좌로 손해배상금을 이체해야 한다. 다만, 다른 수급전용계좌로도 이체할 수 없는 경우에는 손해배상을 받는 자 본인의 주민등록증(모바일 주민등록증을 포함한다) 등 신분증명서의 확인을 거쳐 손해배상금을 직접 현금으로 지급할 수 있다.
