Distant Water Industry Development Act, Article 33 (Penalty provisions)

① 다음 각 호의 어느 하나에 해당하는 자는 5년 이하의 징역 또는 수산물 가액의 5배 이하와 5억원 이상 10억원 이하 중 높은 금액에 상당하는 벌금에 처한다. 다만, 5년 이내에 2회 이상 위반한 자에 대하여는 5년 이하의 징역 또는 수산물 가액의 8배 이하와 16억원 이하 중 높은 금액에 상당하는 벌금에 처한다. <개정 2015.1.6, 2019.11.26>

⑤ 제1항부터 제3항까지의 경우 벌금은 위반행위에 기인한 경제적 이득을 효과적으로 박탈하고 불법ㆍ비보고ㆍ비규제 어업을 억제할 수 있도록 위반의 정도에 상응하는 금액으로 하며, 둘 이상의 위반행위가 동시에 적발된 경우 벌금은 각 위반행위에 상응하는 금액을 합산한다. 다만, 이러한 처벌 수준은 원양산업종사자의 직무 수행상 적법한 권리를 침해하여서는 아니 된다. <신설 2015.1.6>
