원자력시설 등의 방호 및 방사능 방재 대책법 시행령 제40조(업무의 위탁)
Enforcement Decree of the Act on Physical Protection and Radiological Emergency of Nuclear Facilities, etc., Article 40 (Entrustment of Duties)
①원자력안전위원회는 법 제45조제1항에 따라 다음 각 호의 업무를 한국원자력통제기술원에 위탁한다. <개정 2008.2.29, 2011.10.25, 2014.11.19, 2021.6.8>
(1) Pursuant to Article 45 (1) of the Act, the Nuclear Safety and Security Commission entrusts the following duties to the Korea Institute of Nuclear Nonproliferation and Control:
1. 법 제4조제1항에 따른 원자력시설 등에 대한 위협의 평가
1. Assessment of threats to nuclear facilities, etc. under Article 4 (1) of the Act
2. 법 제9조제1항 및 제9조의3제1항에 따른 승인과 법 제13조제2항에 따른 승인ㆍ변경승인에 관련된 심사
2. Review related to approval under Articles 9 (1) and 9-3 (1) of the Act and approval and approval of changes under Article 13 (2) of the Act
3. 법 제9조의2제1항에 따른 교육에 관한 관리 업무
3. Management duties concerning education under Article 9-2 (1) of the Act
4. 법 제9조의3제2항에 따른 훈련 평가 지원
4. Support for drill evaluation under Article 9-3 (2) of the Act
5. 법 제12조제1항 및 제13조의2제1항에 따른 검사
5. Inspections under Articles 12 (1) and 13-2 (1) of the Act
②원자력안전위원회는 법 제45조제1항에 따라 다음 각 호의 업무를 한국원자력안전기술원에 위탁한다. <개정 2008.2.29, 2011.10.25, 2014.11.19, 2021.6.8, 2021.12.23>
(2) Pursuant to Article 45 (1) of the Act, the Nuclear Safety and Security Commission entrusts the following duties to the Korea Institute of Nuclear Safety:
1. 법 제20조제1항(방사선비상진료에 관한 사항은 제외한다), 제20조의2제3항 및 제37조제3항에 따른 승인과 관련된 심사
1. Review related to approval under Articles 20 (1) (excluding matters concerning radiological emergency medical care), 20-2 (3), and 37 (3) of the Act
1의2. 법 제28조제1항에 따른 현장지휘센터 시설ㆍ장비의 구축 및 관리
1-2. Building and management of facilities and equipment of the on-site command center under Article 28 (1) of the Act
2. 법 제36조제1항에 따른 교육에 관한 관리업무
2. Management duties concerning education under Article 36 (1) of the Act
3. 법 제37조제5항에 따른 훈련 평가 지원(방사선비상진료에 관한 사항은 제외한다)
3. Support for drill evaluation under Article 37 (5) of the Act (excluding matters concerning radiological emergency medical care)
4. 법 제38조제1항에 따른 검사(방사선비상진료에 관한 사항은 제외한다)
4. Inspections under Article 38 (1) of the Act (excluding matters concerning radiological emergency medical care)
③ 원자력안전위원회는 법 제45조제1항에 따라 다음 각 호의 업무를 한국원자력의학원에 위탁한다. <신설 2014.11.19, 2021.10.5, 2021.12.23>
(3) Pursuant to Article 45 (1) of the Act, the Nuclear Safety and Security Commission entrusts the following duties to the Korea Institute of Radiological and Medical Sciences:
1. 법 제20조제1항에 따른 승인에 관련된 심사(방사선비상진료에 관한 사항에 한정한다)
1. Review related to approval under Article 20 (1) of the Act (limited to matters concerning radiological emergency medical care)
2. 법 제35조의2제1항에 따른 원자력안전위원회의 갑상샘 방호 약품 비축ㆍ관리
2. Stockpiling and management of thyroid protective medicines by the Nuclear Safety and Security Commission under Article 35-2 (1) of the Act
3. 법 제35조의2제4항에 따른 지침의 작성ㆍ보완을 위한 검토
3. Review for preparing and supplementing guidelines under Article 35-2 (4) of the Act
4. 법 제37조제5항에 따른 훈련 평가 지원(방사선비상진료에 관한 사항에 한정한다)
4. Support for drill evaluation under Article 37 (5) of the Act (limited to matters concerning radiological emergency medical care)
5. 법 제38조제1항에 따른 검사(방사선비상진료에 관한 사항에 한정한다)
5. Inspections under Article 38 (1) of the Act (limited to matters concerning radiological emergency medical care)
6. 법 제46조제1항제1호에 따른 지방자치단체에 대한 갑상샘 방호 약품의 확보ㆍ폐기 지원
