유아교육법 시행령 제29조(무상교육의 내용 및 범위)

① 법 제24조제1항에 따라 초등학교 취학 직전 3년의 유아에 대하여 실시하는 무상교육은 매년 1월 1일 현재 만 3세 이상인 유아로서 다음 각 호의 어느 하나에 해당하는 기관에서 교육부장관과 보건복지부장관이 협의하여 정하는 공통의 교육ㆍ보육과정(이하 "공통과정"이라 한다)을 제공받는 유아를 대상으로 한다. 이 경우 유아가 받을 수 있는 무상교육 기간은 3년을 초과할 수 없다. <개정 2012.8.31, 2013.3.23>

② 1월 2일부터 3월 1일까지의 기간 중에 만 3세가 된 유아가 공통과정을 제공받는 경우에는 제1항 전단에도 불구하고 무상교육의 대상으로 본다. 이 경우 유아가 받을 수 있는 무상교육 기간은 3년을 초과할 수 없다. <개정 2012.8.31>
