Enforcement Decree of the Distribution Industry Development Act, Article 7-2 (Method of Calculating Number of Consenting Persons, etc.)

① 법 제12조제2항제2호에 따른 대규모점포 또는 준대규모점포(이하 "대규모점포등"이라 한다)에 입점하여 영업을 하는 상인(이하 "입점상인"이라 한다)의 동의자 수 산정방법은 다음 각 호와 같다.

1. 해당 대규모점포등에서 「부가가치세법」 제8조, 「소득세법」 제168조 또는 「법인세법」 제111조에 따른 사업자등록을 하고 영업을 하는 입점상인 1명당 하나의 동의권을 가진 사람으로 산정한다.

1. 2. 제1호에도 불구하고 다음 각 목의 구분에 해당하는 경우에는 그에 따라 산정한다.

가. 1명의 입점상인이 2 이상의 점포에서 영업을 하는 경우 하나의 동의권을 가진 사람으로 산정한다.

(a)어 Where웨어 one원 tenant테넌트 merchant머천트 operates아퍼^r레잇츠 in인 two투 or오 more모 stores,스토즈 the^ð더 merchant머천트 shall섈 be비 counted카운티드 as애즈 one원 person퍼슨 holding호울딩 the^ð더 right^r라잇 of어^v브 consent.컨센트

나. 2명 이상의 입점상인이 하나의 점포에서 영업을 하는 경우에는 해당 입점상인 간 합의에 따라 동의권을 행사하기로 선정된 1명을 하나의 동의권을 가진 사람으로 산정한다.

(b)비 Where웨어 two투 or오 more모 tenant테넌트 merchants머천츠 operate아퍼^r레잇 in인 one원 store,스토 one원 person퍼슨 selected설렉티드 to투 exercise엑서사이즈 the^ð더 right^r라잇 of어^v브 consent컨센트 by바이 agreement어그^r리먼트 among어멍 the^ð더 tenant테넌트 merchants머천츠 shall섈 be비 counted카운티드 as애즈 one원 person퍼슨 holding호울딩 the^ð더 right^r라잇 of어^v브 consent.컨센트

② 법 제12조제2항제2호가목에 따라 전체 매장면적에 대한 동의를 얻은 입점상인 운영 매장면적의 비율을 산정할 때 입점상인이 없는 매장을 제외한 매장면적을 전체 매장면적으로 하여 그 비율을 산정한다.

③ 동의권은 다음 각 호의 어느 하나에 해당하는 방법으로 행사할 수 있다. <개정 2020.12.8>

1. 다음 각 목의 어느 하나에 해당하는 전자적 방법

가. 「전자서명법」 제2조제2호에 따른 전자서명 또는 같은 조 제6호에 따른 인증서를 통하여 본인확인을 거쳐 동의권을 행사하는 방법

나. 법 제12조의6에 따른 관리규정(이하 "관리규정"이라 한다)에서 「전자서명법」 제2조제1호에 따른 전자문서를 제출하는 방법 등 가목보다 본인 확인절차를 완화하여 동의권을 행사할 수 있도록 정하고 있는 경우에는 그에 따른 방법

④ 법 제12조제2항에 따른 대규모점포등관리자(이하 "대규모점포등관리자"라 한다)가 되기 위하여 동의를 얻으려는 자는 입점상인의 동의를 받기 1주일 전에 대규모점포등관리자의 구성방법 및 운영계획, 동의권 행사의 기간과 방법을 입점상인에게 통지하여야 한다.
