Enforcement Decree of the Distribution Industry Development Act, Article 7-3 (Management Fees, etc.)
① 법 제12조의3제2항에 따른 관리비의 내용은 다음 각 호와 같고, 각 비용의 세부적인 내용은 별표 3의3과 같다.
(1) The details of management fees under Article 12-3 (2) of the Act are as follows, and the detailed content of each cost is as set forth in Attached Table 3-3:
1. 일반관리비
1. General management costs
2. 청소비
2. Cleaning costs
3. 경비비
3. Security costs
4. 소독비
4. Disinfection costs
5. 승강기유지비
5. Elevator maintenance costs

8. 수선유지비(냉난방시설의 청소비를 포함한다)

② 법 제12조의3제3항에서 "대통령령으로 정하는 사용료 등"이란 다음 각 호의 비용을 말한다.
(2) The "usage fees, etc. prescribed by Presidential Decree" in Article 12-3 (3) of the Act means the following costs:
1. 전기료(공동으로 사용하는 시설의 전기료를 포함한다)
1. Electricity charges (including electricity charges for jointly used facilities)
2. 수도료(공동으로 사용하는 수도료를 포함한다)
2. Water charges (including water charges for jointly used facilities)
3. 가스사용료
3. Gas usage charges
4. 지역난방 방식인 대규모점포등의 냉난방비와 급탕비

③ 대규모점포등관리자는 보수가 필요한 시설[누수(漏水)되는 시설을 포함한다]이 2개 이상 점포의 공동사용에 제공되는 경우에는 직접 보수하고 해당 입점상인이나 소유자에게 그 비용을 따로 부과할 수 있다.
(3) Where facilities requiring repair [including facilities with leaks] are provided for joint use by two or more stores, the large-scale store, etc. manager may repair them directly and separately charge the relevant tenant merchants or owners for the costs.
④ 대규모점포등관리자는 제1항부터 제3항에 따른 금전(이하 "관리비등"이라 한다)의 지급을 입점상인에게 청구하는 경우에는 관리비등의 항목별 산출명세, 연체내용, 수입 및 집행 세부내용을 쉽게 알 수 있도록 정리하여 입점상인에게 알려주어야 한다.
(4) When claiming payment of the money under paragraphs (1) through (3) (hereinafter referred to as "management fees, etc.") from tenant merchants, the large-scale store, etc. manager shall organize and notify tenant merchants of the calculation details by item of management fees, etc., details of arrears, and details of revenue and execution in a manner that is easy to understand.
⑤ 대규모점포등관리자는 관리비등을 다음 각 호의 어느 하나에 해당하는 금융기관에 예치하여 관리하여야 한다.
(5) The large-scale store, etc. manager shall manage management fees, etc., by depositing them with a financial institution falling under any of the following:
1. 「은행법」에 따른 은행
1. A bank under the Banking Act
2. 「중소기업은행법」에 따른 중소기업은행
2. The Industrial Bank of Korea under the Industrial Bank of Korea Act
3. 「상호저축은행법」에 따른 상호저축은행
3. A mutual savings bank under the Mutual Savings Banks Act
4. 「보험업법」에 따른 보험회사
4. An insurance company under the Insurance Business Act
5. 「농업협동조합법」에 따른 조합, 농업협동조합중앙회 및 농협은행
5. A cooperative, the National Agricultural Cooperative Federation, and NH Bank under the Agricultural Cooperatives Act
6. 「수산업협동조합법」에 따른 조합, 수산업협동조합중앙회 및 수협은행
6. A cooperative, the National Federation of Fisheries Cooperatives, and Suhyup Bank under the Fisheries Cooperatives Act
7. 「신용협동조합법」에 따른 신용협동조합 및 신용협동조합중앙회
7. A credit union and the National Credit Union Federation of Korea under the Credit Unions Act

⑥ 대규모점포등관리자는 법 제12조의3제4항에 따라 관리비등의 명세(제1항제6호ㆍ제7호 및 제2항제1호부터 제4호까지는 사용량을 포함한다) 및 제7항에 따른 잡수입의 명세를 관리비등을 청구한 달의 다음 달 말일까지 해당 대규모점포등의 인터넷 홈페이지(인터넷 홈페이지가 없는 경우에는 해당 대규모점포등의 관리사무소나 게시판 등을 말한다. 이하 같다)에 공개하여야 한다.
(6) Pursuant to Article 12-3 (4) of the Act, the large-scale store, etc. manager shall disclose the details of management fees, etc. (including usage amounts for paragraph (1) 6 and 7 and paragraph (2) 1 through 4) and the details of miscellaneous income under paragraph (7) on the internet website of the relevant large-scale store, etc. (where there is no internet website, the management office or bulletin board, etc., of the relevant large-scale store, etc.; the same applies below) by the last day of the month following the month in which the management fees, etc. were claimed.
⑦ 법 제12조의3제4항제3호에서 "대통령령으로 정하는 사항"이란 잡수입(공용부분 및 복리시설의 사용료 등 대규모점포등을 관리하면서 부수적으로 발생하는 수입을 말한다)을 말한다.
(7) The "matters prescribed by Presidential Decree" in Article 12-3 (4) 3 of the Act means miscellaneous income (meaning income incidentally arising from managing the large-scale store, etc., such as usage fees for common areas and welfare facilities).
