장애인복지법 제88조의2(가중처벌)

① 상습적으로 장애인학대관련범죄를 범한 자는 그 죄에서 정한 형의 2분의 1까지 가중한다.

② 제59조의4제2항에 따른 신고의무자가 자기의 보호ㆍ감독 또는 진료를 받는 장애인을 대상으로 장애인학대관련범죄를 범한 때에는 그 죄에서 정한 형의 2분의 1까지 가중한다.
