저작권법 제59조(배타적발행권의 존속기간 등)

①배타적발행권은 그 설정행위에 특약이 없는 때에는 맨 처음 발행등을 한 날부터 3년간 존속한다. 다만, 저작물의 영상화를 위하여 배타적발행권을 설정하는 경우에는 5년으로 한다. <개정 2011.12.2, 2023.8.8>

②저작재산권자는 배타적발행권 존속기간 중 그 배타적발행권의 목적인 저작물의 저작자가 사망한 때에는 제1항에도 불구하고 저작자를 위하여 저작물을 전집 그 밖의 편집물에 수록하거나 전집 그 밖의 편집물의 일부인 저작물을 분리하여 이를 따로 발행등의 방법으로 이용할 수 있다. <개정 2011.12.2>
