전남광주통합특별시 설치를 위한 특별법 제388조(준공검사)

① 사업시행자는 산림이용진흥사업의 전부 또는 일부(제385조제2항제6호에 따른 단계별 조성계획서가 포함된 실시계획을 승인받은 경우로 한정한다)를 완료한 경우에는 통합특별시조례로 정하는 바에 따라 사업완료보고서를 작성하여 통합특별시장에게 준공검사를 받아야 한다.

② 통합특별시장은 제1항에 따른 사업완료보고서를 받으면 지체 없이 준공검사를 하여야 한다. 이 경우 통합특별시장은 효율적인 준공검사를 위하여 필요하면 관계 행정기관ㆍ공공기관ㆍ연구기관, 그 밖의 전문기관 등에 의뢰하여 준공검사를 할 수 있다.

③ 지정권자는 제1항에 따른 사업완료보고서의 내용에 포함된 공공시설을 인수하거나 관리하게 될 국가기관ㆍ지방자치단체 또는 공공기관의 장 등에게 준공검사에 참여할 것을 요청할 수 있으며, 요청을 받은 자는 특별한 사유가 없으면 요청에 따라야 한다.

④ 통합특별시장은 제2항에 따른 준공검사 결과 산림이용진흥사업이 완료되었다고 인정할 때에는 사업시행자에게 준공검사증명서를 교부하고 사업완료 공고를 하여야 하며, 실시계획대로 완료되지 아니하였을 경우에는 지체 없이 보완 시공 등 필요한 조치를 명하여야 한다.

⑤ 제2항에 따라 준공검사를 할 때 통합특별시장이 제382조에 따라 의제되는 인허가등에 따른 준공검사ㆍ준공인가 등에 대하여 제7항에 따라 관계 행정기관의 장과 협의한 사항에 대해서는 그 준공검사ㆍ준공인가 등을 받은 것으로 본다.

⑥ 사업시행자(사업시행자가 통합특별시장인 경우는 제외한다)가 제5항에 따른 준공검사ㆍ준공인가 등의 의제를 받으려면 제1항에 따른 준공검사를 신청할 때 해당 법률에서 정하는 관계 서류를 함께 제출하여야 한다.

⑦ 통합특별시장은 제2항에 따른 준공검사를 할 때 그 내용에 제382조에 따라 의제되는 인허가등에 따른 준공검사ㆍ준공인가 등에 해당하는 사항이 있으면 미리 관계 행정기관의 장과 협의하여야 한다.

⑧ 제1항에 따른 준공검사 전에는 조성된 토지나 설치된 시설을 사용할 수 없다.
