Enforcement Decree of the Electric Power Technology Management Act, Article 20 (Construction Supervision, etc.)
① 법 제12조제2항제1호에서 "대통령령으로 정하는 기관 또는 단체"란 제18조제4항제3호부터 제9호까지의 어느 하나에 해당하는 기관 또는 단체를 말한다.
(1) The "institutions or organizations prescribed by Presidential Decree" in Article 12 (2) 1 of the Act means institutions or organizations falling under any of Article 18 (4) 3 through 9.
② 법 제12조제2항제2호에서 "대통령령으로 정하는 소규모 또는 특수시설물 공사"란 다음 각 호의 전력시설물공사를 말한다. <개정 2021.3.30, 2022.2.8, 2023.11.15, 2026.8.18>
(2) The "small-scale or special facility works prescribed by Presidential Decree" in Article 12 (2) 2 of the Act means the following electric power facility works:
1. 「전기사업법」에 따른 일반용전기설비의 전력시설물공사
1. Electric power facility works of general-use electrical facilities under the Electric Utility Act;
2. 「전기사업법」 제16조에 따른 공급약관에서 정한 임시전력을 공급받기 위한 전력시설물공사
2. Electric power facility works for receiving temporary power supply as prescribed in the supply terms and conditions under Article 16 of the Electric Utility Act;
3. 「군사기지 및 군사시설 보호법」에 따른 군사시설 내의 전력시설물공사
3. Electric power facility works within military facilities under the Protection of Military Bases and Installations Act;
4. 「소방시설공사업법」에 따른 비상전원ㆍ비상조명등 및 비상콘센트설비 공사
4. Works on emergency power, emergency lighting and emergency outlet facilities under the Fire Protection Systems Construction Business Act;
5. 「전기사업법」에 따른 전기사업용전기설비 중 인입선 및 저압배전설비 공사
5. Works on service lines and low-voltage distribution facilities among electrical facilities for electric utility business under the Electric Utility Act;
6. 「전기사업법」에 따른 전기사업자가 시행하는 전력시설물공사로서 그 소속 직원 중 감리원 수첩을 발급받은 사람에게 법 제12조의2제1항 및 제2항에 따라 감리업무를 수행하게 하는 공사
6. Electric power facility works carried out by an electric utility operator under the Electric Utility Act in which supervision duties are performed under Article 12-2 (1) and (2) of the Act by a person belonging to the operator who has been issued a supervisor's handbook;
7. 다음 각 목의 공사를 시행하는 자가 「전기안전관리법」 제22조에 따라 선임된 전기안전관리자에게 감리업무를 수행하게 하는 공사
7. Works in which a person carrying out any of the following works has an electrical safety manager appointed under Article 22 of the Electrical Safety Management Act perform supervision duties:
가. 비상용 예비발전설비의 설치ㆍ변경 공사로서 총공사비가 1억원 미만인 공사
(a) Installation or alteration works of emergency standby power generation facilities with total construction costs of less than 100 million won;
나. 전기수용설비의 증설 또는 변경 공사로서 총공사비가 5천만원 미만인 공사
(b) Expansion or alteration works of electricity receiving facilities with total construction costs of less than 50 million won;
다. 「재생에너지 개발ㆍ이용ㆍ보급 촉진법」 제3호에 따른 재생에너지 설비와 「수소경제 육성 및 수소 안전관리에 관한 법률」 제2조제6호 및 제12호에 따른 연료전지등 및 수소에너지 설비의 증설 또는 변경 공사로서 총공사비가 5천만원 미만인 공사
(c) Expansion or alteration works of renewable energy facilities under subparagraph 3 of the Act on the Promotion of the Development, Use, and Distribution of Renewable Energy and of fuel cells, etc. and hydrogen energy facilities under subparagraphs 6 and 12 of Article 2 of the Hydrogen Economy Promotion and Hydrogen Safety Management Act, with total construction costs of less than 50 million won;
8. 「전기사업법」에 따른 전기사업자가 시행하는 총도급공사비 5천만원 미만인 전력시설물공사로서 소속 전력기술인에게 공사감리업무를 수행하게 하는 공사
8. Electric power facility works with total contract construction costs of less than 50 million won carried out by an electric utility operator under the Electric Utility Act, in which electric power engineers belonging to the operator perform construction supervision duties;
9. 전력시설물 중 토목ㆍ건축 및 기계 부문의 설비 공사
9. Facility works in the civil engineering, architecture and mechanical fields among electric power facilities;
10. 발전기 또는 전압 1,000볼트 이상의 변압기ㆍ차단기ㆍ전선로의 용량 변경을 가져오지 아니하는 전력시설물의 보수 공사. 다만, 다음 각 목의 어느 하나에 해당하는 보수 공사는 제외한다.
10. Repair works of electric power facilities that do not involve a change in the capacity of generators or of transformers, circuit breakers or power lines with a voltage of 1,000 volts or more: Provided, That repair works falling under any of the following are excluded:
가. 「전기사업법」 제61조 및 「전기안전관리법」 제8조에 따른 공사계획의 인가 또는 신고 대상인 보수 공사
(a) Repair works subject to authorization of or reporting on a construction plan under Article 61 of the Electric Utility Act and Article 8 of the Electrical Safety Management Act;
나. 전압 1,000볼트 미만인 전력시설물의 보수 공사로서 「전기사업법」에 따른 자가용전기설비 중 총공사비 5천만원 이상인 전력시설물의 보수 공사와 함께 시행되는 보수 공사
(b) Repair works of electric power facilities with a voltage of less than 1,000 volts that are carried out together with repair works of electric power facilities with total construction costs of 50 million won or more among private electrical facilities under the Electric Utility Act.
③ 발주자와 제2항제6호 또는 법 제12조제2항제1호에 따라 소속 감리원에게 공사감리를 수행하게 하는 자는 여러 개의 전력시설물공사 현장이 인접하여 이를 하나의 공사현장으로 보고 공사감리를 할 수 있는 경우에는 통합하여 감리를 발주하거나 공사감리를 수행하게 할 수 있다.
(3) Where an ordering party and a person who has supervisors belonging to him or her perform construction supervision under paragraph (2) 6 or Article 12 (2) 1 of the Act may regard multiple electric power facility work sites that are adjacent to each other as a single work site and perform construction supervision, they may place orders for supervision or have construction supervision performed on an integrated basis.
④ 제3항에 따른 통합감리에 필요한 사항은 기후에너지환경부장관이 정하여 고시한다. <개정 2013.3.23, 2025.10.1>
(4) Matters necessary for integrated supervision under paragraph (3) shall be determined and publicly notified by the Minister of Climate, Energy and Environment.
