정보통신망 이용촉진 및 정보보호 등에 관한 법률 제23조의3(본인확인기관의 지정 등)

① 방송미디어통신위원회는 다음 각 호의 사항을 심사하여 대체수단의 개발ㆍ제공ㆍ관리 업무(이하 "본인확인업무"라 한다)를 안전하고 신뢰성 있게 수행할 능력이 있다고 인정되는 자를 본인확인기관으로 지정할 수 있다. <개정 2025.10.1>

(1) The^ð더 Broadcasting,브^r로드캐스팅 Media미디아 and앤드 Communications커뮤너케이션즈 Commission커미션 may,메이 after애^f프터 examining이그재미닝 the^ð더 following^f팔로잉 matters,매터즈 designate데저그네잇 as애즈 an앤 identity아이덴티티 verification^v베^r러^f퍼케이션 agency에이전시 a어 person퍼슨 recognized^r레커그나이즈드 as애즈 capable케이퍼블 of어^v브 safely세이^f플리 and앤드 reliably^r릴라이어블리 performing퍼^f포밍 the^ð더 work워크 of어^v브 developing,디^v벨러핑 providing,프^r러^v바이딩 and앤드 managing매너징 alternative올터너티^v브 means민즈 (hereinafter히^r리내^f프터 referred^r러^f퍼드 to투 as애즈 "identity아이덴티티 verification^v베^r러^f퍼케이션 work"):워크

② 본인확인기관이 본인확인업무의 전부 또는 일부를 휴지하고자 하는 때에는 휴지기간을 정하여 휴지하고자 하는 날의 30일 전까지 이를 이용자에게 통보하고 방송미디어통신위원회에 신고하여야 한다. 이 경우 휴지기간은 6개월을 초과할 수 없다. <개정 2025.10.1>

③ 본인확인기관이 본인확인업무를 폐지하고자 하는 때에는 폐지하고자 하는 날의 60일 전까지 이를 이용자에게 통보하고 방송미디어통신위원회에 신고하여야 한다. <개정 2025.10.1>

(3) Where웨어 an앤 identity아이덴티티 verification^v베^r러^f퍼케이션 agency에이전시 intends인텐즈 to투 discontinue디스컨티뉴 its잇츠 identity아이덴티티 verification^v베^r러^f퍼케이션 work,워크 it잇 shall섈 notify노우터^f파이 users유저즈 at앳 least리스트 60 days데이즈 before비^f포 the^ð디 intended인텐디드 date데잇 of어^v브 discontinuance디스컨티뉴언스 and앤드 report^r리포트 it잇 to투 the^ð더 Broadcasting,브^r로드캐스팅 Media미디아 and앤드 Communications커뮤너케이션즈 Commission.커미션

④ 제1항부터 제3항까지의 규정에 따른 심사사항별 세부 심사기준ㆍ지정절차 및 휴지ㆍ폐지 등에 관하여 필요한 사항은 대통령령으로 정한다.
