정신건강증진 및 정신질환자 복지서비스 지원에 관한 법률 제41조(자의입원등)

① 정신질환자나 그 밖에 정신건강상 문제가 있는 사람은 보건복지부령으로 정하는 입원등 신청서를 정신의료기관등의 장에게 제출함으로써 그 정신의료기관등에 자의입원등을 할 수 있다.

② 정신의료기관등의 장은 자의입원등을 한 사람이 퇴원등을 신청한 경우에는 지체 없이 퇴원등을 시켜야 한다.

③ 정신의료기관등의 장은 자의입원등을 한 사람에 대하여 입원등을 한 날부터 2개월마다 퇴원등을 할 의사가 있는지를 확인하여야 한다.
