정신건강증진 및 정신질환자 복지서비스 지원에 관한 법률 제81조의2(상속인 없는 재산의 처리)

① 정신요양시설과 정신재활시설의 설치ㆍ운영자는 그 시설에 입소 중인 사람이 사망하고 그 상속인의 존부가 분명하지 아니한 경우 「민법」 제1053조부터 제1059조까지의 규정에 따라 사망한 사람의 재산을 처리한다. 다만, 사망한 사람의 잔여재산이 「사회복지사업법」 제45조의2제1항 단서에 따른 금액 이하인 경우에는 관할 시장ㆍ군수ㆍ구청장에게 잔여재산 목록을 작성하여 보고하는 것으로 그 재산의 처리를 갈음할 수 있다.

② 제1항 단서에 따른 보고를 받은 시장ㆍ군수ㆍ구청장은 상속인, 일반상속채권자, 유증받은 자, 기타 상속재산에 대하여 권리를 주장하려는 자가 있으면 6개월 내에 그 권리를 주장할 것을 3개월 이상 공고하여야 한다.

③ 제2항에 따른 기간 내에 상속재산에 대하여 권리를 주장하는 자가 있는 때에는 시장ㆍ군수ㆍ구청장이 「민법」 제1034조에 따라 그 기간 내에 신고한 채권자들 간에 배당하여 변제하여야 한다.

④ 제2항에 따른 기간이 경과하여도 상속재산에 대하여 권리를 주장하는 자가 없는 때에는 상속재산은 지방자치단체에 귀속된다.

⑤ 제1항부터 제4항까지에서 규정한 사항 외에 상속인 없는 재산의 처리에 관한 세부절차는 보건복지부령으로 정한다.
