Political Funds Act, Article 26 (Subsidies for Nominating Women Candidates for Public Office)
①국가는 임기만료에 의한 지역구국회의원선거, 지역구시ㆍ도의회의원선거 및 지역구자치구ㆍ시ㆍ군의회의원선거에서 여성후보자를 추천하는 정당에 지급하기 위한 보조금(이하 "여성추천보조금"이라 한다)으로 최근 실시한 임기만료에 의한 국회의원선거의 선거권자 총수에 100원을 곱한 금액을 임기만료에 의한 국회의원선거, 시ㆍ도의회의원선거 또는 자치구ㆍ시ㆍ군의회의원선거가 있는 연도의 예산에 계상하여야 한다. <개정 2006.4.28>
(1) As subsidies to be paid to political parties that nominate women candidates in constituency National Assembly elections, constituency Si/Do council elections and constituency autonomous Gu/Si/Gun council elections held because terms of office expire (hereinafter referred to as "subsidies for nominating women"), the State shall include in the budget for a year in which a National Assembly election, Si/Do council election or autonomous Gu/Si/Gun council election is held because terms of office expire an amount equal to the total number of eligible voters in the most recent National Assembly election held because terms of office expired, multiplied by 100 won.
② 여성추천보조금은 제1항에 따른 선거에서 여성후보자를 추천한 정당에 대하여 다음 각 호에 따라 배분ㆍ지급한다. 이 경우 지역구시ㆍ도의회의원선거와 지역구자치구ㆍ시ㆍ군의회의원선거에서의 여성추천보조금은 제1항에 따라 해당 연도의 예산에 계상된 여성추천보조금의 100분의 50을 각 선거의 여성추천보조금 총액으로 한다. <개정 2022.4.20, 2024.1.2>
(2) Subsidies for nominating women shall be distributed and paid to political parties that nominated women candidates in the elections under paragraph (1) as provided in the following subparagraphs. In this case, for constituency Si/Do council elections and constituency autonomous Gu/Si/Gun council elections, the total amount of subsidies for nominating women for each election shall be 50/100 of the subsidies for nominating women included in the budget for that year under paragraph (1):
1. 여성후보자를 전국지역구총수의 100분의 40 이상 추천한 정당에는 여성추천보조금 총액의 100분의 40을 다음 기준에 따라 배분ㆍ지급한다.
1. To political parties that nominated women candidates in at least 40/100 of all constituencies nationwide, 40/100 of the total subsidies for nominating women shall be distributed and paid according to the following criteria:
가. 배분대상 여성추천보조금 총액의 100분의 40: 지급 당시 정당별 국회의석수의 비율
(a) 40/100 of the total subsidies for nominating women to be distributed: according to each party's share of National Assembly seats at the time of payment;
나. 배분대상 여성추천보조금 총액의 100분의 40: 최근 실시한 임기만료에 따른 국회의원선거에서의 득표수의 비율(비례대표전국선거구 및 지역구에서 해당 정당이 득표한 득표수 비율의 평균을 말한다. 이하 "국회의원선거의 득표수 비율"이라 한다)
(b) 40/100 of the total subsidies for nominating women to be distributed: according to each party's share of votes in the most recent National Assembly election held because terms of office expired (meaning the average of the party's vote shares in the nationwide proportional representation constituency and in the local constituencies; hereinafter referred to as the "vote share in the National Assembly election");
다. 배분대상 여성추천보조금 총액의 100분의 20: 각 정당이 추천한 지역구 여성후보자수의 합에 대한 정당별 지역구 여성후보자수의 비율
(c) 20/100 of the total subsidies for nominating women to be distributed: according to the ratio of each party's number of women constituency candidates to the total number of women constituency candidates nominated by all parties;
2. 여성후보자를 전국지역구총수의 100분의 30 이상 100분의 40 미만을 추천한 정당에는 여성추천보조금 총액의 100분의 30을 제1호 각 목의 기준에 따라 배분ㆍ지급한다. 이 경우 하나의 정당에 배분되는 여성추천보조금은 제1호에 따라 각 정당에 배분되는 여성추천보조금 중 최소액을 초과할 수 없다.
2. To political parties that nominated women candidates in at least 30/100 but less than 40/100 of all constituencies nationwide, 30/100 of the total subsidies for nominating women shall be distributed and paid according to the criteria in the items of subparagraph 1. In this case, the subsidies for nominating women distributed to one party shall not exceed the smallest amount distributed to any party under subparagraph 1;
3. 여성후보자를 전국지역구총수의 100분의 20 이상 100분의 30 미만을 추천한 정당에는 여성추천보조금 총액의 100분의 20을 제1호 각 목의 기준에 따라 배분ㆍ지급한다. 이 경우 하나의 정당에 배분되는 여성추천보조금은 제2호에 따라 각 정당에 배분되는 여성추천보조금 중 최소액을 초과할 수 없다.
3. To political parties that nominated women candidates in at least 20/100 but less than 30/100 of all constituencies nationwide, 20/100 of the total subsidies for nominating women shall be distributed and paid according to the criteria in the items of subparagraph 1. In this case, the subsidies for nominating women distributed to one party shall not exceed the smallest amount distributed to any party under subparagraph 2;
4. 여성후보자를 전국지역구총수의 100분의 10 이상 100분의 20 미만을 추천한 정당에는 여성추천보조금 총액의 100분의 10을 제1호 각 목의 기준에 따라 배분ㆍ지급한다. 이 경우 하나의 정당에 배분되는 여성추천보조금은 제3호에 따라 각 정당에 배분되는 여성추천보조금 중 최소액을 초과할 수 없다.
4. To political parties that nominated women candidates in at least 10/100 but less than 20/100 of all constituencies nationwide, 10/100 of the total subsidies for nominating women shall be distributed and paid according to the criteria in the items of subparagraph 1. In this case, the subsidies for nominating women distributed to one party shall not exceed the smallest amount distributed to any party under subparagraph 3.
③여성추천보조금은 임기만료에 의한 지역구국회의원선거, 지역구시ㆍ도의회의원선거 또는 지역구자치구ㆍ시ㆍ군의회의원선거의 후보자등록마감일 후 2일 이내에 정당에 지급한다. <개정 2006.4.28>
(3) Subsidies for nominating women shall be paid to political parties within two days after the deadline for candidate registration for the constituency National Assembly election, constituency Si/Do council election or constituency autonomous Gu/Si/Gun council election held because terms of office expire.
