주민소환에 관한 법률 시행령 제2조(주민소환투표청구 서명인 수)

① 법 제7조제2항 본문 및 제3항 본문에 따라 특별시장ㆍ광역시장ㆍ도지사(이하 "시ㆍ도지사"라 한다)의 주민소환투표청구를 위하여 해당 특별시ㆍ광역시ㆍ도 관할구역 안의 시ㆍ군ㆍ자치구 전체의 수가 3개 이상인 경우에 3분의 1 이상의 시ㆍ군ㆍ자치구에서 받아야 할 서명인 수와 시장ㆍ군수ㆍ구청장(자치구의 구청장을 말한다. 이하 같다) 및 지방의회의원(비례대표선거구시ㆍ도의회의원과 비례대표선거구자치구ㆍ시ㆍ군의회의원을 제외한다. 이하 같다)의 주민소환투표청구를 위하여 해당 선거구 안의 읍ㆍ면ㆍ동의 전체의 수가 3개 이상인 경우에 3분의 1 이상의 읍ㆍ면ㆍ동에서 받아야 할 서명인 수는 다음 각 호와 같다.

② 제1항에 따라 산정된 서명인 수가 각각 해당 지방자치단체의 장 또는 해당 지방의회의원 선거구 안의 주민소환투표청구권자 총수의 1만분의 5미만인 경우에 서명을 받아야 할 서명인 수는 1만분의 5로 하고, 1만분의 100을 초과하는 경우에 서명을 받아야 할 서명인 수는 1만분의 100으로 한다.

③ 지방자치단체의 장은 매년 1월 10일까지 제1항과 제2항에 따라 산정된 서명인 수를 법 제7조제5항에 따른 주민소환투표청구권자 총수와 함께 공표하여야 한다.

④ 제3항에 따른 공표는 관보, 공보 또는 1개 이상의 일간신문에 게재(揭載)하고 해당 지방자치단체의 게시판이나 인터넷 홈페이지에 게시하는 방법으로 한다.
