다. 세대구분형 공동주택의 세대수가 해당 주택단지 안의 공동주택 전체 세대수의 10분의 1과 해당 동의 전체 세대수의 3분의 1을 각각 넘지 않을 것. 다만, 특별자치시장, 특별자치도지사, 시장, 군수 또는 구청장(구청장은 자치구의 구청장을 말하며, 이하 "시장ㆍ군수ㆍ구청장"이라 한다)이 부대시설의 규모 등 해당 주택단지의 여건을 고려하여 인정하는 범위에서 세대수의 기준을 넘을 수 있다.
