주택법 제68조(증축형 리모델링의 안전진단)

① 제2조제25호나목 및 다목에 따라 증축하는 리모델링(이하 "증축형 리모델링"이라 한다)을 하려는 자는 시장ㆍ군수ㆍ구청장에게 안전진단을 요청하여야 하며, 안전진단을 요청받은 시장ㆍ군수ㆍ구청장은 해당 건축물의 증축 가능 여부의 확인 등을 위하여 안전진단을 실시하여야 한다.

② 시장ㆍ군수ㆍ구청장은 제1항에 따라 안전진단을 실시하는 경우에는 대통령령으로 정하는 기관에 안전진단을 의뢰하여야 하며, 안전진단을 의뢰받은 기관은 리모델링을 하려는 자가 추천한 건축구조기술사(구조설계를 담당할 자를 말한다)와 함께 안전진단을 실시하여야 한다.

③ 시장ㆍ군수ㆍ구청장이 제1항에 따른 안전진단으로 건축물 구조의 안전에 위험이 있다고 평가하여 「도시 및 주거환경정비법」 제2조제2호다목에 따른 재건축사업 및 「소규모주택정비에 관한 특례법」 제2조제1항제3호다목에 따른 소규모재건축사업의 시행이 필요하다고 결정한 건축물은 증축형 리모델링을 하여서는 아니 된다. <개정 2017.2.8, 2026.9.8>

④ 시장ㆍ군수ㆍ구청장은 제66조제1항에 따라 수직증축형 리모델링을 허가한 후에 해당 건축물의 구조안전성 등에 대한 상세 확인을 위하여 안전진단을 실시하여야 한다. 이 경우 안전진단을 의뢰받은 기관은 제2항에 따른 건축구조기술사와 함께 안전진단을 실시하여야 하며, 리모델링을 하려는 자는 안전진단 후 구조설계의 변경 등이 필요한 경우에는 건축구조기술사로 하여금 이를 보완하도록 하여야 한다.

⑤ 제2항 및 제4항에 따라 안전진단을 의뢰받은 기관은 국토교통부장관이 정하여 고시하는 기준에 따라 안전진단을 실시하고, 국토교통부령으로 정하는 방법 및 절차에 따라 안전진단 결과보고서를 작성하여 안전진단을 요청한 자와 시장ㆍ군수ㆍ구청장에게 제출하여야 한다.

⑥ 시장ㆍ군수ㆍ구청장은 제1항 및 제4항에 따라 안전진단을 실시하는 비용의 전부 또는 일부를 리모델링을 하려는 자에게 부담하게 할 수 있다.

⑦ 그 밖에 안전진단에 관하여 필요한 사항은 대통령령으로 정한다.
