지뢰피해자 지원에 관한 특별법 시행령 제9조(월평균임금의 적용)

① 법 제4조제1항제1호에 따른 월평균임금(이하 "월평균임금"이라 한다)에 관한 증명자료가 없을 때에는 매년 1회 이상 주기적으로 임금통계를 공표하는 임금조사기관이 직종별로 조사한 남녀별 전국 규모의 통계에 따른 월급액이나 일용노동임금을 월평균임금으로 한다.

② 제1항을 적용할 때 월평균임금은 먼저 고용노동부의 고용형태별 근로실태조사보고서의 통계에 따르고, 고용형태별 근로실태조사보고서가 없는 경우에는 국가데이터처의 건설노임단가통계에 따르며, 건설노임단가통계도 없는 경우에는 공신력이 있는 방법에 따라 조사한 남녀별 보통 인부의 월급액이나 일용노동임금에 따른다. 다만, 임금의 하한은 지뢰사고를 당한 해의 전년도 직종별 임금실태조사보고서의 통계에 따른 남녀별 월평균임금으로 한다. <개정 2025.10.1>

③ 위원회는 제1항 및 제2항에 따른 통계가 없거나 불명확한 경우에는 제5조제1항제1호에 따른 피해자 및 유족 여부 심사 실무위원회의 의견과 임금통계(지뢰사고 당시 공표되어 있던 임금통계 중 가장 최근의 통계를 말한다)가 있는 해부터 지뢰사고를 당한 해까지의 물가상승률 등을 고려하여 월평균임금을 결정한다. 다만, 월평균임금의 상한은 피해자가 지뢰사고를 당한 이후 최초로 공표된 제1항 및 제2항에 따른 통계의 남녀별 월평균임금으로 한다. <신설 2016.12.30>
