지방공무원 교육훈련법 시행령 제31조(위탁교육훈련 대상자의 선발)

① 지방자치단체의 장과 지방의회의 의장은 다음 각 호의 요건을 모두 갖춘 공무원 중에서 위탁교육훈련 대상자를 선발해야 한다. <개정 2021.11.30>

② 징계처분을 받은 사람은 그 처분기간이 끝난 날부터 1년이 지나지 아니하면 교육훈련기간이 6개월 이상인 위탁교육훈련의 대상자로 선발될 수 없다. 다만, 성실하고 능동적인 업무처리과정에서 과실로 인하여 발생한 비위사실로 인정되어 「지방공무원 징계 및 소청 규정」 제8조에 따른 징계양정기준에 따라 감경된 징계처분을 받은 사람은 예외로 한다.
