지방소도읍 육성 지원법 제17조(공공시설등 및 토지의 귀속 등)

① 제7조제1호부터 제3호까지의 규정에 따른 사업시행자가 개발사업의 시행으로 새로 공공시설등을 설치하거나 기존의 공공시설등에 대체되는 공공시설등을 설치한 경우에는 「국유재산법」 및 「공유재산 및 물품 관리법」의 규정에도 불구하고 종래의 공공시설등과 그 공공시설등이 접하여 있는 토지는 사업시행자에게 무상(無償)으로 귀속되고 새로 설치된 공공시설등과 그 공공시설등이 접하여 있는 토지는 그 시설을 관리할 국가 또는 지방자치단체에 무상으로 귀속된다.

② 제7조제3호에 따른 민간개발사업자가 개발사업의 시행으로 새로 설치한 공공시설등 또는 기존의 공공시설등에 대체하여 설치한 공공시설등은 그 시설을 관리할 국가 또는 지방자치단체에 무상으로 귀속되며, 개발사업의 시행으로 용도가 폐지되는 종래의 공공시설등과 그 공공시설등이 접하여 있는 토지는 「국유재산법」 및 「공유재산 및 물품 관리법」의 규정에도 불구하고 민간개발사업자가 새로 설치한 공공시설등의 설치비용에 상당하는 범위에서 민간개발사업자에게 무상으로 양도할 수 있다.

③ 관할 시장ㆍ군수는 제1항에 따른 공공시설등의 귀속 등에 관한 사항이 포함된 개발사업 시행을 승인하거나 시행할 때에는 미리 그 관리청의 의견을 들어야 한다. 승인사항을 변경하는 경우에도 또한 같다.
