지방자치단체를 당사자로 하는 계약에 관한 법률 시행령 제40조(개찰과 낙찰선언)

① 지방자치단체의 장 또는 계약담당자는 입찰공고에 표시한 장소와 일시에 입찰자가 참석한 자리에서 개찰하여야 한다. 이 경우 입찰자로서 출석하지 아니한 자가 있으면 입찰사무와 관계없는 공무원으로 하여금 참석하게 할 수 있다.

② 지방자치단체의 장 또는 계약담당자는 적격자를 낙찰자로 결정하였을 때에는 지체 없이 낙찰선언을 하여야 한다.

③ 제39조제1항에 따라 정보처리장치를 이용하여 입찰서를 제출하는 경우에는 제1항과 제2항에도 불구하고 입찰공고에 표시한 절차와 방법에 따라 개찰과 낙찰선언을 한다. <개정 2022.9.20>
