채무자 회생 및 파산에 관한 법률 제497조(별제권의 목적물의 환가)

①파산관재인은 「민사집행법」에 의하여 별제권의 목적인 재산을 환가할 수 있다. 이 경우 별제권자는 이를 거절할 수 없다.

②제1항의 경우 별제권자가 받을 금액이 아직 확정되지 아니한 때에는 파산관재인은 대금을 따로 임치하여야 한다. 이 경우 별제권은 그 대금 위에 존재한다.
