책임운영기관의 설치ㆍ운영에 관한 법률 시행령 제16조(공무원의 정원)

① 법 제16조제1항에 따라 소속책임운영기관의 종류별ㆍ계급별 정원 또는 고위공무원단에 속하는 공무원의 정원을 총리령 또는 부령으로 정하는 경우에는 소속책임운영기관 및 그 부속기관의 장의 직위와 고위공무원단에 속하는 공무원으로 임명하는 직위에 부여되는 공무원의 종류와 계급 또는 직무등급(「국가공무원법」 제23조에 따라 인사혁신처장이 행정안전부장관과 협의하여 배정하는 직무등급을 말한다. 이하 같다)을 명시하여야 한다. <개정 2013.3.23, 2014.11.19, 2017.7.26>

② 소속책임운영기관에 두는 공무원의 직급별 정원은 법 제16조제1항에 따른 계급별 정원의 범위에서 기본운영규정으로 정한다. 다만, 고위공무원단에 속하는 공무원의 경우에는 종류와 정원을 구체적으로 정한다.

③ 법 제16조제1항 후단에 따라 소속책임운영기관의 종류별ㆍ계급별 정원을 총리령 또는 부령에 통합하여 정하는 경우에는 소속책임운영기관별 인건비 총액의 범위에서 정하여야 한다. 이 경우 종류별ㆍ계급별 정원의 규정 방식 및 배정 기준에 대해서는 행정안전부장관이 따로 정한다. <개정 2013.3.23, 2014.11.19, 2017.7.26>
