청원법 제21조(청원의 처리 등)

① 청원기관의 장은 청원심의회의 심의를 거쳐 청원을 처리하여야 한다. 다만, 청원심의회의 심의를 거칠 필요가 없는 사항에 대해서는 심의를 생략할 수 있다.

② 청원기관의 장은 청원을 접수한 때에는 특별한 사유가 없으면 90일 이내(제13조제1항에 따른 공개청원의 공개 여부 결정기간 및 같은 조 제2항에 따른 국민의 의견을 듣는 기간을 제외한다)에 처리결과를 청원인(공동청원의 경우 대표자를 말한다)에게 알려야 한다. 이 경우 공개청원의 처리결과는 온라인청원시스템에 공개하여야 한다.

③ 청원기관의 장은 부득이한 사유로 제2항에 따른 처리기간에 청원을 처리하기 곤란한 경우에는 60일의 범위에서 한 차례만 처리기간을 연장할 수 있다. 이 경우 그 사유와 처리예정기한을 지체 없이 청원인(공동청원의 경우 대표자를 말한다)에게 알려야 한다.

④ 제1항 단서의 청원심의회의 심의를 거칠 필요가 없는 사항 및 제2항에 따른 처리결과를 알리는 방식 등에 필요한 사항은 대법원규칙, 헌법재판소규칙, 중앙선거관리위원회규칙 및 대통령령으로 정한다.
