특허권 등의 등록령 제28조(등록의 순서)

① 신청에 의한 등록은 접수번호 순에 따른다.

② 직권에 의한 등록은 등록의 원인이 생긴 순서에 따른다.

③ 제2항에도 불구하고 특허권등(국제등록디자인권 및 국제등록기초상표권은 제외한다)의 설정등록, 지정상품의 추가등록, 상표권의 존속기간갱신등록신청은 등록료를 납부(등록료 일부를 납부하지 아니한 경우를 포함한다)한 납부서가 접수된 순서에 따른다. 다만, 지식재산처장이 부여한 납부자번호(이하 "지정납부자번호"라 한다)로 등록료를 납부하는 경우에는 등록료의 수납 정보가 지식재산처 전산정보처리조직의 파일에 기록되는 순서에 따라 등록하여야 한다. <개정 2014.6.17, 2025.10.1>
