특허권 등의 등록령 제5조(등록 신청의 접수 시기 및 등록의 효력발생 시기)

① 등록 신청은 등록번호, 신청인의 성명 등 신청서의 기재내용이 지식재산처 전산정보처리조직에 저장된 때에 접수된 것으로 본다. <개정 2025.10.1>

② 등록 신청이 수리(受理)된 경우 그 등록은 접수된 때부터 효력을 발생한다.
