112신고의 운영 및 처리에 관한 법률 제8조(112신고에 대한 조치)

① 경찰청장등은 제7조제1항에 따라 112신고가 접수된 때에는 경찰관을 현장에 신속하게 출동시켜 위험 발생의 방지, 범죄의 예방ㆍ진압, 구호대상자의 구조 등 필요한 조치를 하게 하여야 한다.

② 제1항에 따라 필요한 조치를 한 경찰관은 해당 112신고와 관련하여 범죄의 혐의가 있다고 인정할 만한 상당한 이유가 있어 계속 수사할 필요가 있는 경우 지체 없이 해당 수사기관에 인계하여야 한다.

③ 경찰관은 제1항에 따른 필요한 조치를 할 때 사람의 생명ㆍ신체 또는 재산에 대한 급박한 위해가 발생할 우려가 있는 경우에는 그 위해를 방지하거나 피해자를 구조하기 위하여 부득이하다고 인정하면 합리적으로 판단하여 필요한 한도에서 다른 사람의 토지ㆍ건물 또는 그 밖의 물건을 일시사용, 사용의 제한 또는 처분을 하거나 다른 사람의 토지ㆍ건물ㆍ배 또는 차에 출입할 수 있다.

④ 경찰청장등은 112신고를 처리하는 과정에서 재난ㆍ재해, 범죄 또는 그 밖의 위급한 상황이 발생하여 사람의 생명ㆍ신체를 위험하게 할 것으로 인정할 때에는 일정한 구역을 정하여 그 구역에 있는 사람에게 그 구역 밖으로 피난할 것을 명할 수 있다.

⑤ 경찰관은 제3항에 따라 출입 등 조치를 할 때에는 그 신분을 표시하는 증표를 제시하여야 하며, 소속과 성명을 밝히고 조치의 목적과 이유를 설명하여야 한다.

⑥ 국가는 제1항, 제3항 또는 제4항에 따른 조치나 명령으로 손실을 입은 자가 있는 경우에는 「경찰관 직무집행법」 제11조의2에 따라 그 손실을 보상하여야 한다.
