5ㆍ18민주화운동 진상규명을 위한 특별법 시행령 제11조(조사의 절차 및 방법)

① 위원회는 법 제27조제1항에 따른 조치를 하는 경우 서면으로 하여야 한다.

② 위원회는 법 제27조제1항제2호에 따라 진술청취(이하 "진술청취"라 한다)를 하는 경우 그 내용을 조서로 작성하여야 한다. 이 경우 위원회는 필요한 경우에는 조사대상자 및 참고인의 동의를 얻어 소속 직원에게 진술내용을 녹음하게 하거나 진술장면을 녹화하게 할 수 있다.

③ 진술청취는 법 제27조제1항제6호에 따른 실지조사(이하 "실지조사"라 한다)의 경우를 제외하고는 위원회의 사무실에서 하여야 한다. 다만, 조사대상자 또는 참고인이 요청하거나 필요한 경우에는 위원장의 승인을 받아 다른 장소에서 할 수 있다.

④ 위원회는 실지조사를 할 때에는 미리 기관등에 일시ㆍ장소 및 목적 등을 알려야 하며, 실지조사를 하는 위원회의 위원 또는 소속 직원은 그 권한을 표시하는 별지 제1호서식의 증표를 관계인에게 제시해야 한다. <개정 2021.8.10>

⑤ 위원회는 필요하다고 인정하는 경우에는 관계 공무원 또는 관계 전문가 등을 실지조사에 참여하게 하거나 공청회를 개최하는 등의 방법으로 국내외 관계 전문가의 의견을 들을 수 있다.

⑥ 위원회는 조사대상자, 참고인 또는 관련 증거ㆍ자료가 국외에 있다고 판단되는 경우에는 결정으로 외교적 경로를 통하여 해당 국가에 협조를 요청할 수 있다.
