공유수면 관리 및 매립에 관한 법률 제18조(준공검사 등)

① 제17조제1항에 따라 점용ㆍ사용 실시계획의 승인을 받은 자는 해당 공사를 완료하면 지체 없이 대통령령으로 정하는 바에 따라 공유수면관리청에 준공검사를 신청하여야 한다. 다만, 필요한 경우 해당 공사를 전부 완료하기 전이라도 공사를 완료한 일부에 대하여 해양수산부령으로 정하는 바에 따라 준공검사를 신청할 수 있다. <개정 2017.3.21>

② 제17조제2항에 따라 점용ㆍ사용 실시계획의 신고를 한 자는 해당 공사를 완료하면 지체 없이 대통령령으로 정하는 바에 따라 공유수면관리청에 공사 완료를 신고하여야 한다.

③ 공유수면관리청은 제2항에 따른 신고를 받은 날부터 10일 이내에 신고수리 여부를 신고인에게 통지하여야 한다. <신설 2019.8.20>

④ 공유수면관리청이 제3항에서 정한 기간 내에 신고수리 여부 또는 민원 처리 관련 법령에 따른 처리기간의 연장을 신고인에게 통지하지 아니하면 그 기간(민원 처리 관련 법령에 따라 처리기간이 연장 또는 재연장된 경우에는 해당 처리기간을 말한다)이 끝난 날의 다음 날에 신고를 수리한 것으로 본다. <신설 2019.8.20>

⑤ 공유수면관리청은 대통령령으로 정하는 바에 따라 제1항에 따른 준공검사를 한 결과 그 공사가 제17조제1항에 따라 승인받은 점용ㆍ사용 실시계획의 내용대로 시행되었다고 인정할 때에는 해양수산부령으로 정하는 준공검사확인증을 내주어야 한다. <개정 2013.3.23, 2019.8.20>

⑥ 공유수면관리청은 제3항 또는 제5항에 따라 공사 완료 신고를 수리하거나(제4항에 따라 신고수리를 한 것으로 보는 경우를 포함한다) 준공검사를 하였으면 대통령령으로 정하는 바에 따라 그 사실을 고시하여야 한다. <개정 2019.8.20>
