공직선거법 제181조(개표참관)

①구ㆍ시ㆍ군선거관리위원회는 개표참관인으로 하여금 개표소안에서 개표상황을 참관하게 하여야 한다.

②제1항의 개표참관인은 구ㆍ시ㆍ군선거관리위원회의 관할구역안에서 실시되는 선거에 후보자를 추천하는 정당은 6인을, 무소속후보자는 3인을 선정하여 선거일 전 2일까지 당해 구ㆍ시ㆍ군선거관리위원회에 서면으로 신고하여 참관하게 하되, 신고후 언제든지 교체할 수 있으며 개표일에는 개표소에서 교체신고를 할 수 있다. <개정 1995.4.1, 2000.2.16, 2004.3.12, 2005.8.4, 2018.4.6>

③제2항의 규정에 의한 개표참관인의 신고가 없거나 한 정당 또는 한 후보자가 선정한 개표참관인밖에 없는 때에는 구ㆍ시ㆍ군선거관리위원회가 선거권자 중에서 본인의 승낙을 얻어 12인[지역구자치구ㆍ시ㆍ군의원선거에 있어서는 6인(한 정당이 선정한 개표참관인밖에 없는 때에는 9인)]에 달할 때까지 선정한 자를 개표참관인으로 한다. <개정 1995.4.1, 2004.3.12, 2005.8.4, 2012.1.17>

④제3항의 규정에 의하여 구ㆍ시ㆍ군선거관리위원회가 선정한 개표참관인은 정당한 사유없이 참관을 거부하거나 그 직을 사임할 수 없다.

⑤ 구ㆍ시ㆍ군선거관리위원회는 제2항 및 제3항에도 불구하고 개표장소, 선거인수 등을 고려하여 선거권자의 신청을 받아 제2항에 따라 정당 또는 후보자가 신고할 수 있는 개표참관인 수의 100분의 20 이내에서 개표참관인을 추가로 선정하여 참관하게 할 수 있다. <신설 2015.8.13>

⑥개표참관인은 투표구에서 송부된 투표함의 인계ㆍ인수절차를 참관하고 투표함의 봉쇄ㆍ봉인을 검사하며 그 관리상황을 참관할 수 있다. <개정 2015.8.13>

⑦구ㆍ시ㆍ군선거관리위원회는 개표참관인이 개표내용을 식별할 수 있는 가까운 거리(1미터 이상 2미터 이내)에서 참관할 수 있도록 개표참관인석을 마련하여야 한다. <개정 2015.8.13>

⑧구ㆍ시ㆍ군선거관리위원회는 개표참관인이 개표에 관한 위법사항을 발견하여 그 시정을 요구한 경우에 그 요구가 정당하다고 인정되는 때에는 이를 시정하여야 한다. <개정 2015.8.13>

⑨개표참관인은 개표소안에서 개표상황을 언제든지 순회ㆍ감시 또는 촬영할 수 있으며, 당해 구ㆍ시ㆍ군선거관리위원회위원장이 개표소안 또는 일반관람인석에 지정한 장소에 전화 ㆍ컴퓨터 기타의 통신설비를 설치하고, 이를 이용하여 개표상황을 후보자 또는 정당에 통보할 수 있다. <개정 2015.8.13>

⑩구ㆍ시ㆍ군선거관리위원회는 원활한 개표관리를 위하여 필요한 경우에는 개표참관인을 교대하여 참관하게 할 수 있다. 이 경우 정당ㆍ후보자별로 참관인수의 2분의 1씩 교대하여 참관하게 하여야 한다. <개정 2004.3.12, 2015.8.13>

⑫개표참관인신고서의 서식 기타 필요한 사항은 중앙선거관리위원회규칙으로 정한다.
