공직선거법 제22조(시ㆍ도의회의 의원정수)

① 시ㆍ도별 지역구시ㆍ도의원의 총 정수는 그 관할구역 안의 자치구ㆍ시ㆍ군(하나의 자치구ㆍ시ㆍ군이 2 이상의 국회의원지역구로 된 경우에는 국회의원지역구를 말하며, 행정구역의 변경으로 국회의원지역구와 행정구역이 합치되지 아니하게 된 때에는 행정구역을 말한다)수의 2배수로 하되, 인구ㆍ행정구역ㆍ지세ㆍ교통, 그 밖의 조건을 고려하여 100분의 20의 범위에서 조정할 수 있다. 다만, 인구가 5만명 미만인 자치구ㆍ시ㆍ군의 지역구시ㆍ도의원정수는 최소 1명으로 하고, 인구가 5만명 이상인 자치구ㆍ시ㆍ군의 지역구시ㆍ도의원정수는 최소 2명으로 한다. <개정 2014.2.13, 2016.3.3, 2022.4.20>

②제1항에도 불구하고 「지방자치법」 제10조제2항에 따라 시와 군을 통합하여 도농복합형태의 시로 한 경우에는 시ㆍ군통합후 최초로 실시하는 임기만료에 의한 시ㆍ도의회의원선거에 한하여 해당 시를 관할하는 도의회의원의 정수 및 해당 시의 도의회의원의 정수는 통합 전의 수를 고려하여 이를 정한다. <개정 1998.4.30, 2005.8.4, 2010.1.25, 2021.1.12>

③제1항 및 제2항의 기준에 의하여 산정된 의원정수가 19명 미만이 되는 광역시 및 도는 그 정수를 19명으로 한다. <개정 1998.4.30, 2002.3.7, 2010.1.25>

④비례대표시ㆍ도의원정수는 제1항 내지 제3항의 규정에 의하여 산정된 지역구시ㆍ도의원정수의 100분의 14로 한다. 이 경우 단수는 1로 본다. 다만, 산정된 비례대표시ㆍ도의원정수가 3인 미만인 때에는 3인으로 한다. <신설 1995.4.1, 2026.4.22>
