공직선거법 제57조의8(당내경선 등을 위한 휴대전화 가상번호의 제공)

① 국회에 의석을 가진 정당은 다음 각 호의 어느 하나에 해당하는 경우에는 관할 선거관리위원회를 경유하여 이동통신사업자에게 이용자의 이동전화번호가 노출되지 아니하도록 생성한 번호(이하 "휴대전화 가상번호"라 한다)를 제공하여 줄 것을 서면(이하 "휴대전화 가상번호 제공 요청서"라 한다)으로 요청할 수 있다. <개정 2017.2.8>

② 정당은 다음 각 호의 기간까지 관할 선거관리위원회에 휴대전화 가상번호 제공 요청서를 제출하여야 하고, 관할 선거관리위원회는 해당 요청서의 기재사항을 심사한 후 제출받은 날부터 2일 이내에 해당 요청서를 이동통신사업자에게 송부하여야 한다. <개정 2017.2.8, 2026.4.22>

③ 정당이 제1항에 따른 요청을 하는 경우에는 휴대전화 가상번호 제공 요청서에 다음 각 호에 따른 사항을 적어야 한다. <개정 2017.2.8>

④ 관할 선거관리위원회는 제출된 휴대전화 가상번호 제공 요청서에 제3항에 따른 기재사항이 누락되었거나 심사를 위하여 추가로 자료가 필요하다고 판단되는 때에는 해당 정당에 휴대전화 가상번호 제공 요청서의 보완 또는 자료의 제출을 요구할 수 있으며, 그 요구를 받은 정당은 지체 없이 이에 따라야 한다. <개정 2017.2.8>

⑤ 이동통신사업자가 제1항에 따른 요청을 받은 때에는 그 요청을 받은 날부터 5일 이내에 휴대전화 가상번호 제공 요청서에 따라 휴대전화 가상번호를 생성하여 유효기간을 설정한 다음 관할 선거관리위원회를 경유하여 해당 정당에 제공하여야 한다. 다만, 이동통신사업자는 이용자 수의 부족 등으로 제공할 수 있는 휴대전화 가상번호 수가 제공하여야 하는 휴대전화 가상번호 수 보다 적은 때에는 지체 없이 관할 선거관리위원회에 통보하여야 하고, 관할 선거관리위원회는 중앙선거관리위원회규칙으로 정하는 바에 따라 해당 정당과 협의하여 제공하여야 하는 휴대전화 가상번호 수를 조정할 수 있다. <개정 2017.2.8, 2026.4.22>

⑥ 이동통신사업자는 중앙선거관리위원회규칙으로 정하는 바에 따라 이용자에게 정당의 당내경선이나 여론수렴 등을 위하여 본인의 이동전화번호가 정당에 휴대전화 가상번호로 제공된다는 사실과 그 제공을 거부할 수 있다는 사실을 알려야 한다. <개정 2017.2.8>

⑦ 이동통신사업자(그 대표자 및 구성원을 포함한다)가 제5항에 따라 휴대전화 가상번호를 제공할 때에는 다음 각 호의 어느 하나에 해당하는 행위를 하여서는 아니 된다. <개정 2017.2.8>

⑧ 정당은 제5항에 따라 제공받은 휴대전화 가상번호를 제1항에 따른 여론조사를 실시하거나 여론수렴을 하기 위하여 여론조사 기관ㆍ단체에 제공할 수 있다. <개정 2017.2.8>

⑨ 제5항 본문 또는 제8항에 따라 휴대전화 가상번호를 제공받은 정당(그 대표자 및 구성원을 포함한다) 또는 여론조사 기관ㆍ단체(그 대표자 및 구성원을 포함한다)는 다음 각 호의 어느 하나에 해당하는 행위를 하여서는 아니 된다. <개정 2017.2.8>

⑩ 휴대전화 가상번호를 제공받은 자(그 대표자 및 구성원을 포함한다)는 유효기간이 지난 휴대전화 가상번호를 즉시 폐기하여야 한다. <개정 2017.2.8>

⑪ 이동통신사업자가 제5항에 따라 휴대전화 가상번호를 생성하여 제공하는데 소요되는 비용은 휴대전화 가상번호의 제공을 요청한 해당 정당이 부담한다. 이 경우 이동통신사업자는 휴대전화 가상번호 생성ㆍ제공에 소요되는 최소한의 비용을 청구하여야 한다. <개정 2017.2.8>

⑫ 누구든지 휴대전화 가상번호를 제공한 이동통신사업자에게 당내경선의 결과ㆍ효력이나 여론수렴의 결과에 대하여 이의를 제기할 수 없다. <개정 2017.2.8>

⑬ 휴대전화 가상번호 제공 요청 방법과 절차, 휴대전화 가상번호의 유효기간 설정, 휴대전화 가상번호 제공 요청서 서식, 관할 선거관리위원회, 그 밖에 필요한 사항은 중앙선거관리위원회규칙으로 정한다. <개정 2017.2.8>
