공직선거법 제82조(언론기관의 후보자등 초청 대담ㆍ토론회)

①텔레비전 및 라디오 방송시설(제70조제1항에 따른 방송시설을 말한다. 이하 이 조에서 같다)ㆍ「신문 등의 진흥에 관한 법률」 제2조제3호에 따른 신문사업자ㆍ「잡지 등 정기간행물의 진흥에 관한 법률」 제2조제2호에 따른 정기간행물사업자(정보간행물ㆍ전자간행물ㆍ기타간행물을 발행하는 자를 제외한다)ㆍ「뉴스통신진흥에 관한 법률」 제2조제3호에 따른 뉴스통신사업자 및 인터넷언론사(이하 이 조에서 "언론기관"이라 한다)는 선거운동기간중 후보자 또는 대담ㆍ토론자(후보자가 선거운동을 할 수 있는 자중에서 지정하는 자를 말한다)에 대하여 후보자의 승낙을 받아 1명 또는 여러 명을 초청하여 소속정당의 정강ㆍ정책이나 후보자의 정견, 그 밖의 사항을 알아보기 위한 대담ㆍ토론회를 개최하고 이를 보도할 수 있다. 다만, 제59조에도 불구하고 대통령선거에서는 선거일 전 1년부터, 국회의원선거 또는 지방자치단체의장선거에 있어서는 선거일전 60일부터 선거기간개시일전일까지 후보자가 되고자 하는 자를 초청하여 대담ㆍ토론회를 개최하고 이를 보도할 수 있다. 이 경우 방송시설이 대담ㆍ토론회를 개최하고 이를 방송하고자 하는 때에는 내용을 편집하지 않은 상태에서 방송하여야 하며, 대담ㆍ토론회의 방송일시와 진행방법등을 중앙선거관리위원회규칙이 정하는 바에 따라 관할선거구선거관리위원회에 통보하여야 한다. <개정 1997.11.14, 1998.4.30, 2000.2.16, 2005.8.4, 2007.1.3, 2008.2.29, 2009.7.31, 2010.1.25>

②제1항의 대담ㆍ토론회는 언론기관이 방송시간ㆍ신문의 지면 등을 고려하여 자율적으로 개최한다.

③제1항의 대담ㆍ토론의 진행은 공정하여야 하며, 이에 관하여 필요한 사항은 중앙선거관리위원회규칙으로 정한다.

④제71조(候補者 등의 放送演說)제12항, 제72조(放送施設主管 候補者 演說의 放送)제2항 및 제81조(團體의 候補者 등 초청 對談ㆍ討論會)제2항ㆍ제6항ㆍ제7항의 규정은 언론기관의 후보자 등 초청 대담ㆍ토론회에 이를 준용한다. <개정 2000.2.16>
