관광진흥법 제31조(조건부 영업허가)

①특별자치시장ㆍ특별자치도지사ㆍ시장ㆍ군수ㆍ구청장은 테마파크업 허가를 할 때 5년의 범위에서 대통령령으로 정하는 기간에 제5조제2항에 따른 시설 및 설비를 갖출 것을 조건으로 허가할 수 있다. 다만, 천재지변이나 그 밖의 부득이한 사유가 있다고 인정하는 경우에는 해당 사업자의 신청에 따라 한 차례만 1년을 넘지 아니하는 범위에서 그 기간을 연장할 수 있다. <개정 2008.6.5, 2011.4.5, 2018.6.12, 2023.8.8, 2024.2.27>

②특별자치시장ㆍ특별자치도지사ㆍ시장ㆍ군수ㆍ구청장은 제1항에 따른 허가를 받은 자가 정당한 사유 없이 제1항에 따른 기간에 허가 조건을 이행하지 아니하면 그 허가를 즉시 취소하여야 한다. <개정 2008.6.5, 2011.4.5, 2018.6.12>

③ 제1항에 따른 허가를 받은 자는 제1항에 따른 기간 내에 허가 조건에 해당하는 필요한 시설 및 기구를 갖춘 경우 그 내용을 특별자치시장ㆍ특별자치도지사ㆍ시장ㆍ군수ㆍ구청장에게 신고하여야 한다. <신설 2011.4.5, 2018.6.12>

④ 특별자치시장ㆍ특별자치도지사ㆍ시장ㆍ군수ㆍ구청장은 제3항에 따른 신고를 받은 날부터 문화체육관광부령으로 정하는 기간 내에 신고수리 여부를 신고인에게 통지하여야 한다. <신설 2018.6.12>

⑤ 특별자치시장ㆍ특별자치도지사ㆍ시장ㆍ군수ㆍ구청장이 제4항에서 정한 기간 내에 신고수리 여부 또는 민원 처리 관련 법령에 따른 처리기간의 연장을 신고인에게 통지하지 아니하면 그 기간(민원 처리 관련 법령에 따라 처리기간이 연장 또는 재연장된 경우에는 해당 처리기간을 말한다)이 끝난 날의 다음 날에 신고를 수리한 것으로 본다. <신설 2018.6.12>
