관세법 제140조(물품의 하역)

① 국제무역선이나 국제무역기는 제135조에 따른 입항절차를 마친 후가 아니면 물품을 하역하거나 환적할 수 없다. 다만, 세관장의 허가를 받은 경우에는 그러하지 아니하다. <개정 2020.12.22>

② 세관장은 제1항 단서에 따른 허가의 신청을 받은 날부터 10일 이내에 허가 여부를 신청인에게 통지하여야 한다. <신설 2018.12.31>

③ 세관장이 제2항에서 정한 기간 내에 허가 여부 또는 민원 처리 관련 법령에 따른 처리기간의 연장을 신청인에게 통지하지 아니하면 그 기간(민원 처리 관련 법령에 따라 처리기간이 연장 또는 재연장된 경우에는 해당 처리기간을 말한다)이 끝난 날의 다음 날에 허가를 한 것으로 본다. <신설 2018.12.31>

④ 국제무역선이나 국제무역기에 물품을 하역하려면 세관장에게 신고하고 현장에서 세관공무원의 확인을 받아야 한다. 다만, 세관공무원이 확인할 필요가 없다고 인정하는 경우에는 그러하지 아니하다. <개정 2018.12.31, 2020.12.22, 2021.12.21>

⑤ 세관장은 감시ㆍ단속을 위하여 필요할 때에는 제4항에 따라 물품을 하역하는 장소 및 통로(이하 "하역통로"라 한다)와 기간을 관세청장이 정하는 바에 따라 제한할 수 있다. <개정 2018.12.31, 2024.12.31>

⑥ 국제무역선이나 국제무역기에는 내국물품을 적재할 수 없으며, 국내운항선이나 국내운항기에는 외국물품을 적재할 수 없다. 다만, 세관장의 허가를 받았을 때에는 그러하지 아니하다. <개정 2018.12.31, 2020.12.22>

⑦ 세관장은 제4항에 따라 신고된 물품이 폐기물ㆍ화학물질 등 관세청장이 관계 중앙행정기관의 장과 협의하여 고시하는 물품으로서 하역 장소 및 통로, 기간을 제한하는 방법으로는 사회안전 또는 국민보건 피해를 방지하기 어렵다고 인정되는 경우에는 하역을 제한하고, 적절한 조치 또는 반송을 명할 수 있다. <신설 2020.12.22>
