관세법 제270조의2(가격조작죄)
Customs Act, Article 270-2 (Crime of Price Manipulation)
제1호에 따른 신청 또는 신고를 할 때 부당하게 재물이나 재산상 이득을 취득하거나 제3자로 하여금 이를 취득하게 할 목적으로 물품의 가격을 조작하여 신청 또는 신고한 자는 2년 이하의 징역 또는 제2호에 따른 금액 이하의 벌금에 처한다. <개정 2024.12.31>
A person who, when filing an application or declaration under subparagraph 1, manipulates the price of goods in the application or declaration for the purpose of unjustly obtaining property or a pecuniary advantage, or having a third person obtain it, shall be punished by imprisonment with labor for not more than two years or by a fine not exceeding the amount under subparagraph 2:
1. 다음 각 목의 어느 하나에 해당하는 신청 또는 신고
1. Any of the following applications or declarations:
가. 제38조의2제1항ㆍ제2항에 따른 보정신청
(a) An application for correction under Article 38-2 (1) or (2);
나. 제38조의3제1항에 따른 수정신고
(b) An amended declaration under Article 38-3 (1);
다. 제241조제1항ㆍ제2항에 따른 신고
(c) A declaration under Article 241 (1) or (2);
라. 제244조제1항에 따른 신고
(d) A declaration under Article 244 (1);
2. 다음 각 목의 금액 중 가장 높은 금액
2. The highest of the following amounts:
가. 5천만원
(a) 50 million won;
나. 물품원가
(b) The cost of the goods;
다. 다음 1) 및 2) 간의 차액
(c) The difference between 1) and 2) below:
1) 제1호 각 목의 어느 하나에 해당하는 신청 또는 신고를 한 물품가격
1) The price of the goods stated in an application or declaration under any item of subparagraph 1;
2) 과세가격(제241조제1항ㆍ제2항에 따른 수출신고 또는 반송신고의 경우에는 해당 물품을 국제무역선 또는 국제무역기에 인도하는 조건으로 실제로 지급받았거나 지급받아야 할 가격으로서 최종 선적항 또는 선적지까지의 운임ㆍ보험료를 포함한 가격을 말한다)
2) The dutiable value (for an export declaration or return shipment declaration under Article 241 (1) or (2), the price actually paid or payable on condition of delivering the goods to an international trade vessel or international trade aircraft, including freight and insurance up to the final port or place of shipment);
