③ 임용권자나 임용제청권자는 제1항제3호에 따라 소속 공무원을 면직시킬 때에는 임용 형태, 업무 실적, 직무수행 능력, 징계처분 사실 등을 고려하여 면직 기준을 정하여야 한다. <개정 2008.3.28>

④ 제3항에 따른 면직 기준을 정하거나 제1항제3호에 따라 면직 대상자를 결정할 때에는 임용권자 또는 임용제청권자(임용권자나 임용제청권자가 분명하지 아니하면 중앙인사관장기관의 장을 말한다)별로 심사위원회를 구성하여 그 심사위원회의 심의ㆍ의결을 거쳐야 한다. <개정 2008.3.28>

⑤ 제4항에 따른 심사위원회의 위원장은 임용권자 또는 임용제청권자가 되며, 위원은 면직 대상자보다 상위 계급자 또는 고위공무원단에 속하는 일반직공무원 중에서 위원장이 지명하는 5명 이상 7명 이하로 구성하되, 면직 대상자의 상위 계급자 또는 고위공무원단에 속하는 일반직공무원을 우선하여 지명하여야 한다. 다만, 상위 계급자 또는 고위공무원단에 속하는 일반직공무원이 부족하면 4명 이내로 구성할 수 있다. <개정 2008.3.28, 2015.5.18>
