국민연금법 제100조(과오납금의 충당과 반환)

①공단은 연금보험료, 연체금, 체납처분비에서 발생한 과오납금이 있으면 대통령령으로 정하는 바에 따라 그 과오납금을 연금보험료나 그 밖의 이 법에 따른 징수금에 충당하여야 한다. <개정 2009.5.21>

② 제1항에 따라 충당하고 남은 금액이 있는 경우 공단은 이를 반환결정하여야 하고, 건강보험공단은 대통령령으로 정하는 바에 따라 지급하여야 한다. <신설 2009.5.21>
