National Pension Act, Article 126 (Application to Foreigners)

① 이 법의 적용을 받는 사업장에 사용되고 있거나 국내에 거주하는 외국인으로서 대통령령으로 정하는 자 외의 외국인은 제6조에도 불구하고 당연히 사업장가입자 또는 지역가입자가 된다. 다만, 이 법에 따른 국민연금에 상응하는 연금에 관하여 그 외국인의 본국 법이 대한민국 국민에게 적용되지 아니하면 그러하지 아니하다. <개정 2015.1.28>

② 제1항 본문에 따라 가입 중이거나 가입한 적이 있는 외국인(이하 "외국인 가입자등"이라 한다)에게 제67조제1항제1호를 적용하기 위해서는 질병이나 부상의 초진일이 국내 거주 기간 내에 있어야 한다. 그 밖에 외국인 가입자등에 대한 장애연금의 수급권 발생ㆍ정지ㆍ소멸 및 장애연금 지급 등에 관한 사항은 제67조(제67조제3항제2호는 제외한다)부터 제71조까지의 규정을 준용한다. <신설 2016.5.29>

③ 외국인 가입자등이 국내 거주 중에 사망한 경우에는 제72조제2항제2호를 적용하지 아니한다. 그 밖에 외국인 가입자등에 대한 유족연금의 수급권 발생ㆍ정지ㆍ소멸 및 유족연금 지급 등에 관한 사항은 제72조부터 제76조까지의 규정을 준용한다. <신설 2016.5.29>

④ 외국인 가입자등에게는 제77조부터 제79조까지의 규정을 적용하지 아니한다. 다만, 다음 각 호의 어느 하나에 해당하는 외국인에 대하여는 그러하지 아니하다. <개정 2015.1.28, 2016.5.29>

1. 외국인의 본국 법에 따라 대한민국 국민이 급여(제49조제1호부터 제3호까지의 급여에 상응하는 급여를 말한다)의 수급권을 취득하지 못하고 제77조제1항 각 호의 어느 하나에 해당하게 된 때에 그 대한민국 국민에게 일정 금액(가입기간 중 낸 연금보험료에 기초하여 산정한 금액을 말한다)을 일시금으로 지급하도록 그 나라 법에서 규정하고 있는 경우의 외국인
